Oh joy of joys, just spoke to tech support again and pulled up the FAQ for the fair use policy and the swines have changed it! It now reads

For the small number of customers who are in the top 5% of heaviest users, our traffic management solution will temporarily set download speeds to no lower than 80Kbit/s.

So they've moved the goalposts without telling anybody, thanks a bloody bunch VM!
