Have you tried rebooting your modem? Unplug it for 30 seconds or so, then plug it back in. That's what I had to do for the upgrade to kick in.

Well we were due for upgrade from 4 to 10 in February. Did speed test today with result of 4.13 rebooted cable modem and speed tests (have done several) are now reading around 5.6.

Go into the modem configuration: -
http://192.168.100.1/
Username and password are both "root". If it says "Maximum Downstream Data Rate : 10240000 bps" under operation configuration, then you've been upgraded. Speed tests aren't always accurate. Sometimes they can be way off.
