The last time I did a risk assessment you had to be trained on the use of ladders at work, so if that's the case then according to Health & Safety you are responsible for you own health and safety and those who will be effected by your actions or omissions. Therefore it was his stupid fault for not checking the ladder.

Totally agree with you on the one. Unfortunately, it's now part of the compensation culture that we now have in this country.
