I regularly get burst speeds of 20% more than what my top speed should be, not for very long, but it does happen.
Measured using what....

Some programs are very inaccurate for that firefox for instance will start downloading as soon as you hit the link but will only start calculating the speed when you've actually told it where to save to.

It then sees that it already has say 10% of the file and takes that into account when calculating speeds but doesn't take into account the start time so just assumes it got that 10% in no time at all, makes for some very interesting speed readings at the start of a download.
