I'm with you on this one. It certainly makes sense to me.
(Yet) another analogy could be...
Consider the LeMans 24hr race...has any team actually won it by agreeing to only run their cars at half their maximum speed for a third of the race? Of couse not, because this would be an unfair limitation.
and another...
If you work for 9 hours at £10/hr, how would you feel if your employer said that he was only prepared to pay you £5/hr for a third of the time? £75 per day as opposed to £90?
I know these are pretty simplistic, but I'm at work at the moment so most of my brain cells are employed elsewhere
