Don't know about legal downloads for good but rental for sure is becoming widely available, a few examples are in an article here:

Downloading of games is legal too such as the case of Steam etc.
No doubt bandwidth needs will burst through the ceiling at which point it'll be up to the ISPs to provide, however still gotta say that at the moment the price of connections is probably skewed up somewhat to cater for heavier users, and with these technologies in their infancy legal demand for large amounts of data each month is still pretty small.
Even with these services you're gonna struggle to download much more than 100GB/month, going by the massive users I know of who download far more than they ever actually use.
