Incorrect billing- telephone & BB

Since March when I threatened to leave to Tiscali, retentions offered me telephone rental, talk unltd 24 and 10MB broadband for £32.99. I received my telephone contract stating free line rental, with £14 for talk unltd 24.

However since that time, i have been billed £11+ every month for the line rental, plus £14+ for talk unltd 24, and my seperate bill for BB, initially was for £17.50 (supposedly for 3 months according to the bill), now it has gone back to full price of £34.99. Having phone CS and spoken to retentions numerous times, the bill still isn't correct.

The last call to CS resulted in the lady saying my bill had been corrected, however when I asked regarding the line rental refund from April, she stated I would have to send a copy of my rental agreement in , to get a refund from then, why should I have to do this, they should know how much I have to pay each month.

My question is this, I am mightily peeved, they can't get their act together and bill me the correct amount as promised in March. As my telephone agreement says free line rental, and they are charging me for the line rental, are they in breech of contract, such that i can cancel at any time, without penalty?

How are you paying, Direct Debit? If so trundle off to your bank and insist they refund you under the Driect Debit Guarantee.

Write to ntl, recorded delivery, enclosing a copy of your agreement. Yes they should have it on file, but we are talking ntl's rather messy systems here. Complain about the overcharging, and state you have sought refund from the bank, as ntl seem incapable of doing so, and that you want correct billing in future.

As for breach of contract, I would suggest yes. ntl are only entitled to bill you for the contrated amount. More than that is wrong, and any refusal to refund immediately is theft. But then I'm not a lwyer, so what do I know

the bank should not entertain any indemnity of charges ntl have advised the customer of......in fact if they did all that would happen is that festoids account would be debited by the amount of the indemnity and ntl would ask him to pay that instead...fairly pointless excecise in my opinion
