Debit taken early..
 
i've just checked my bank account and ntl have taken the dd early putting my account over the agreed limit can they do this?

How early , each month i get a bill stating the money will be taken on or around a certain date. And i get this a good 2 weeks before its due .

4 days so not nuff money was in my account

A direct debit is supposed to be taken at least 10 days after your bill date unless you have a fixed amount taken every month. If you have a fixed amount then it will be debited on the date you have requested or have been informed about!

If anyone takes a DD on a date before it is supposed to taken then you can charge them any costs you have incured!

BT kept doing it to my mother for a period of nealy six months, they soon bucked up though when they had to cough up £35.00 a month plus interest!

my bill shows the date they will take the money, every direct debit I have agreed to in the past has always a date specified so I know when it is withdrawn. If they have taken it early I would guess they in breach but I am no legal expert so I dont know where you stand in getting the fee back.

You should contact your bank and tell them NTL have taken the debit incorrectly - under the direct debit guarantee they must cancel the debit if you complain. Not sure how the bank conveys that to NTL (if at all!). This should mean you will not have been overdrawn.

Then probably NTL will have to send you a letter telling you the debit was not taken and that you owe them money. And they will probably have to arrange a new direct debit instruction with you. I once cancelled my NTL direct debit by mistake (online banking - clicked the wrong item!) and that was what happened for me.

if you indemnify a payment the bank refund you,the bank then request payment from ntl and your account is put into debit unless notes on the account state differently...you then have to pay the debt....much better to speak with cmr servicesa dn get then to credi the account although if im honest i work in the payets dept and its very rare we take a debit eary,sometimes late but rarely early!

well if he asked ntl to refund he will remain out of pocket on the bank charges, unless ntl agree to pay them the better option is to chargeback the direct debit and then pay ntl manually.
