Nokia under warranty --O2
 

They could not repair my N95 and they gave me a used N95 as a replacement. Is this legally allowed?

Yes, it says a "replacement" nothing about new or refurbished one...

Well mobile phone insurance is often, teh same, a refurbished phone or a similar spec model so in answer to your question yes.

It should obviously be in the same or better condition though
