Is the court case proceeding

Have VM formally announced what the status of the "court case" is - whether they are following through with it or not?
If they are, they should have served their letter in advance of service by now on BSkyB and I would have thought a press release to this effect would have been circulated, by either/both sides, in the name of good PR/expectation-management?
If they are not, maybe that's why they have just announced their release of a very occasional HBO programme on "repeat-on-demand" - to try to cover-up the loss of face in this regard?
