Arrest after suspected burglar is killed
 
A 39-year-old man has been arrested after a suspected burglar was stabbed and died at a house in Bramhall, according to Greater Manchester Police

On the basis we know next to nothing about this case, from the little we do know I'd say he may have a good chance of getting off this, or at leave getting off a murder charge.

He was attacked/burgled by 2 people which generally speaking usually means a weapon can be justified as self defence. As long as they hadn't agreed to leave the property and he stabbed them repeatedly on their way out or something daft like that they I can see this going his way.

it happend to my family when i was 20 someone broke into my house and attacked my mum, so i did what i thought was right and defended her, maybe i hit him a few more times than what the law states as reasonable force but i didnt see it like that at the time when the police turned up they arrested me under a section 18, the charges were dropped, but still if a criminal is willing to brake into someones house then they should have the right to defend there family

I accept its your right to protect and if it was self defence no question its reasonable.

My fear if this becomes more widespread then the worry is deteroration of situation as a whole. Burgulars wont stop they did'nt in america however what they did was they came tooled up either brandishing knifes or god forbid guns. Homeowners will then get bigger weapons to defend themselves next thing you know everyone got guns.

Could we deterorate to this level.

I have no sympathy for the burglar whatsoever, if a guy or girl breaks into my house, he will get thrown out of the first window, and my boot stuck to his goolies, so he won't run far.

The homeowner should be released from custody as i feel he has done nothing wrong.

**** bag burglars should not be in peoples houses it is that simple and i don't see any problem giving them a good kicking if they are. If they attack the owner with a knife then they should expect the same back and if they end up dead thats there problem.

The police need to be sure beyond any reasonable doubt that the guy he stabbed was not just someone who has wondered in to the wrong house, or already invited in to the premises.

The problem with knee-jerk reactions is it leaves too much to risk. Once the police have established all the facts then they guy should be released if it is proven he used reasonable force.

In fairness the law is not governed by your experiences (or lack of). Soldiers I'm sure would go in all guns blazing, police on the other hand prefer to establish facts first.

That's a very black and white way of looking at the situation.

The problem is that when the Police go in, the only thing they know is that there are two people in the house, one alive one dead.

There could be any number of reasons the dead person was there, but the one who is alive could just claim he was burgling. The Police should not accept that claim at face value. The "burglar" may not have been a burglar and could have been there legitimately.

It is right that the Police arrested the man while they investigated what actually happened. It is also right that if it goes to court then the jury will probably slightly favour the houseowner when delivering a verdict (after all, a good percentage of them will be houseowners, and all of them will be able to imagine the pain of having their house invaded).

oh dear he died trying to steal from somebodys house i really have no sympathy for him or his family , my sympathy goes to the guy who had to defend himself from **** like this , i would have done the same , i would use any means necessary to protect my family and my home from utter **** like this and if more people did the same and it became more widespread then mr burglar may think twice about breaking into a property and taking what is not his because he is a lazy git .

As my bike was stolen on Saturday, I have no time or sympathy whatsoever for thieving ****. I often wonder if the "backward" countries that chop thieves' mitts off haven't got a point! :mad:

I realy don't think there is any doubt about the victims guilt so as far as i am concerned ,and i'm going to go out on a limb here ,the filthy **** bag got what he deserved .
My main concern is the future safety of the family as quite obviously the deceased **** bag has some very unsavoury family and friends who think it is acceptable to leave flowers and messages of condolences outside the families house,i wouldn't put it passed them to start terrorising the family or even the neighbourhood

The guy has been released on bail following an enquiry into the killing ... Also the flowers have now been removed.

The police and the whole neighbourhood should thank everyone who kills a burglar particularly with the burglars own knife.

Lets hope the guy gets a medal for ridding us of another dangerous , knife wielding villain.

2 years ago my sons bike was stolen ,i ended up getting a police caution because i smacked the kids father who was sitting drinking beer and laughing because he thought i couldn't do anything about it ,....i am a 6' 4" builder :D

I believe that the coalition government can do something good whilst it is in power and give householders the right, that if someone breaks into your property you be be given and amnesty, if the suspect ends up seriously injured or fatal.

It is about time the law was change to allow the householder that right, l am fed up to the back teeth, of hearing stories like this, and the worst thing is the media dig up all the crap on both parties.

I understand what you are saying Arthur ,but giving people the right to seriously hurt or kill other people is wrong .Self defense is just that ,if a person feels threatened ,and the law agrees with them ,they have the right to defend themselves or members of their family in a reasonable way ,in other words if a unarmed burglar is stealing stuff and tries to run away when caught but the homeowner goes to his kitchen and gets a big carving knife and kills the burglar that is murder not self defense

I really wonder what their definition of a "bad lad" would be.

Strange that people thought that he wasn't a bad lad , bearing in mind that he and two friends "beat a man up to a pulp" previously ... He did go to jail for it and was well known to the police as a career burglar.

Maybe his friends and relatives are all a lot worse than him which is why they thought he wasn't a bad lad.

I didn't know that the UK was a baseball playing nation ... Sales of alloy baseball bats have escalated recently to epidemic proportions ... If nobody in the house plays baseball , the bat becomes an offensive weapon.

If you accidentally hit a burglar because he walked into your bat during your indoor baseball practice , would that count as murder or would it be an accident.

If a **** bag enter's a house with a weapon and intend to use it then the home owner is fully within his right to defend his own life and if that means the **** bag loses his so be it.

If it is after the ******* leaves the house and is no longer a threat then yes that is classed as revenge and murder. However that is not what has been happening in the cases in this thread

I think people defending their homes should be able to use reasonable and justifiable force.

We are told we can use Reasonable and Justifiable force on the doors and in close protection which I believe should be copied into homes.

Justifiable force is something you can explain in court

E.G: I stabbed the intruder with a kitchen knife because he was armed with a knife and made a lunge - That is completely justifiable force and any Judge would throw any charges against the guy defending himself out of the window.

I personally think people should be allowed to keep Stun guns / Tasers inside their homes with a licence as a self defence precaution.

In the case above I have not read the entire story but if the burglar made no threat towards the defenders life, that is NOT justifiable force.

So is the home owners next door neighbour in the house as well, should the home owner do as some would want and lie down and take one for England like a good pacifist would?

Far as i am concerned i WILL defend myself and my family from any ******* who is in my HOUSE uninvited and threatens my family i will not just let them get on with it. I am not a coward or a white feather carrying pacifist .

It gets stranger and stranger. The older guy (making an assumption it's the householder) was a shotgun license holder and had a number of legally held weapons so he must have also had other weapons to go with his 'tomato plants'

The younger one is also being charged with producing cannabis and possession of ammunition when prohibited (so not a stranger to the inside of a prison then :rolleyes: )

A fall out between grower and dealer?

Also are firearms holders not subject to semi-regular inspections of their homes to make sure they have sufficient security for their weapons and are agreeing with the terms of their license or is that only a Scottish thing?
