Moved house, can't get Virgin, but they won't let me terminate contact

Apologies if this is the wrong forum to post in, I really didn't know where else to turn.

I've just moved house and the new place is a non cable area. So Virgin can't supply me with Internet or Cable TV.

My problem is that they won't let me leave my contract and want me to pay for a service I simply can not get from them.

My only choice is to get freeview and the internet from another supplier via the phone line but I can't afford to pay for something from Virgin I can't get.

How on earth can I leave them and terminate my contract due to them not being able to supply me with any service.

HELP PLEASE!!!!!!!

how long into a contract were you with them before you moved?

grow 19-06-2008 11:28

Re: Moved house, can't get Virgin, but they won't let me terminate contact

I was 9 months into my 12 month contract.

However......

Because the customer service rep said we could only get the non cable service we got signed up to that. But I didn't realise that it started a fresh 12 month contract, rather than changing the one I already had.

Its a nightmare.

Re: Moved house, can't get Virgin, but they won't let me terminate contact

You should have 30 days to cancel the new contract if you're not satisified, however you may still have to pay the 3 months of the old contract

I'm a bit confused. In you first post you said

Quote:

Which means as you are not continuing with Virgin Services you would be charge an for disconnecting your cable contract early

However you then say this

Quote:

Which means that you would be refunded any Early Disconnection fee from your cable contract as you are keeping Virgin Services

Yes, thats right. You will be charged for ending your cable contract as you have moved out, but as long as you take up beyond cable (Virgin.net) at your new address the cancellation charge is then nullified.
Just call cable customer services and give them your beyond cable account number

If they cannot provide you service in your new house then just tell them and ask to speak to a manager, you do not have to pay the cancellation charge if the outcome is not your fault.

Erm yes you do - Your contract is 12 months. If you move your contract is still 12 months.

I'm fairly sure that VM would use their power of discretion IF the moving customer can provide proof of the move.

Re: Moved house, can't get Virgin, but they won't let me terminate contact

You have to pay the penalty for cancelling your contract within the minimum term, this is standard in the internet and telecommunications industries. If they can service your new address then, as a courtesy they will waive the early termination fee in exchange for taking up the new contract.

Incorrect, IF you are moving to an area where they cannot provide you with a service (you signed up for cable, adsl is a new contract, different matter)

You can cancel without being charged for the remainder of the contract.

I've done it before, as have others, if CS wont let you then you speak to a manager, simple as.

That has not applied since at least Feb 2007 when it became Virgin Media, so anyone currently under contract cannot do that. Now the ONLY exception if you move to a non-serviceable property and don't take services is if you do so within 28 days of the first ever install date (as Virgin's own money back guarantee would apply)

This also written into the Virgin Terms under section K2
Quote:

If you move to another address during any minimum period paragraph J2 will apply, unless you continue to receive our services at your new address (in which case paragraph K3 will apply).
and J2 says
Quote:

If you end this agreement before the end of the minimum period for any of the services (other than in the circumstances outlined in section K or paragraph J3), you must immediately pay (to Virgin Media Payments) the balance of the line rental (if this applies) or the monthly charges (or both) that you would have paid for the rest of the minimum period for each separate service (based on the line rental and monthly charges that you are paying when your agreement ends).
A Manager will not be able to override this as it is Virgin Media Policy. Simple as.

Well my new place can only offer me virgin.net stuff so I'm hoping to transfer to that. Going to call them tomorro and see what they are going to chage me to do that (from my current package)

Hope it's not too much.

But it certainly isn't Virgin Media's fault that you took out a new 12 month contract and then moved while still in it.

If you have have had those fees waived then good for you, but it is not Company policy, and it is unlikely that it will happen again

If, after the disconnection fees have been applied, you want to dispute it, you are more than welcome to do so, but again it is highly unlikely that they will be reversed

Re: Moved house, can't get Virgin, but they won't let me terminate contact

I can't see how Virgin Can legally charge the entire amount unused.

Firstly there is the unfair provisions in consumer contracts. This to me seems quite biased in favour of the company.

If a charge is allowed, where is the reasonable level of that charge - just as everyone is complaining about bank charges being unfair , i.e. no the actual cost, but a penalty, so the VM charge should reflect the actual losses in cancellation of the contract, not the total amount. In other words, what is the loss of profit, unused pay off proportion of the install, maybe a small admin fee, and perhaps any nominal amount VM are forced to pay out in carriage fees for TV servces (only if those are charged on a 12 month basis by the TV co).

Finally, its always been the case that you can upgrade / downgrade most of the services / packages you take on a monthly basis. Unless that policy has been changed, then a total cancellation of all packages, should only be chargeable at a rate no greater that the minimum level of services possible.

The Early Disconnection fee is calculated at £10 per service per month unless that service costs less that £10 per month.

So if you had the VIP bundle, you would be charged £30 per month, rather than £85, to until the end of the contract.

If you are on the £15.50 Phone and BB M offer, you would only be charge £15.50 per month to the end.

It's an unfair world, I don't believe that it is fair to charge someone when virgin cannot cover a hell of a lot of areas in the UK anyway...but unluckily, it is in their terms and conditions. Sods law they always get their ass covered!

Virgin CAN cover the whole of the UK, just not with the same services. This is the whole point.

Just as the LLU providers such as TalkTalk, Sky, AOL etc don't cover the whole of the UK with the same services (and make you pay up to disconnect if you are in minimum term and don't want to transfer services)

MMMmmm I guess I should call them again then because this is not what I got told on the phone this morning.

They told me I would have to pay my full £65 a month.

Edit - Anyway i'll be getting my up to 8mb - unlimited land line calls and a free wireless kit for £19.99 a month so that'll do me.

They did try to get me to pay £40 for a freeview box which I thought was a bit odd.

Kellargh 23-06-2008 15:48

Re: Moved house, can't get Virgin, but they won't let me terminate contact

Well no, they cannot cover all areas. For example, Mumbles (Swansea) is not covered by cable, and if you try to get their freeview service thats apparently 'available' to offnet, they then turn around and say you cant get that either!

BenMcr 23-06-2008 16:07

Re: Moved house, can't get Virgin, but they won't let me terminate contact

Well if anyone really wants a Freeview box from Virgin they can get one HERE (Just click enter shop, you don't need to log in), but that wouldn't count as a service anyway for what we are talking about.

As long you do what Jefferson_T has done, i.e. take Virgin ADSL Broadband, you will not be charged any EDF

You know sometimes people have to move house because the company has moved to another part of the country and they have to move so as to keep their job.Sometimes people have to move because they have a family tragedy and cannot afford to continue living in the same house or the council/housing association have found them a home after years of being on the waiting list.People split up as well and this usually means someone has to move home...

Penalising folk because of situations beyond their control hardly seems fair and it certainly does not smack of good customer relations.

I agree - but more to the point, it definitely isn't VM's fault.

A customer signs and agrees to a 12 month minimum term contract for a service. The minimum term just means if you do need to cancel before the term is up you have to pay the remainder of the 12 months. If they let some people off for circumstances which aren't within your control then why not let someone off when they just choose to move?

Or are we suggesting people don't read the terms or sign (an indication of agreeing) without agreeing to them?

I'm all for people righting wrongs where the company they are with is at fault, but I don't see the point here, when ordering VM a client agrees to a 12 month minimum contract and not honouring that is a tort, so they are allowed to get compensation for the remainder of the term. It is illegal for that to be charged as a penalty so they just reclaim the charges they are entitled to because the customer failed to honour the deal.

Plus there is, as has been said, always ADSL.

If I agreed to a 12 month minimum term then I would expect to pay the remainder of the term.

If you're asking for anything to be waived you're relying on the company's goodwill refunding you. They may well do it as a customer service / goodwill gesture, and probably should, but they don't have to.

How about if VM decide they don't want to supply you again and just kick the contract for no reason with no notice?

Why do some of you people always expect VM to do something that NO other company would do?

A 12 month contract is just that - If you leave after 6 months VM more than likely make a loss overall. Its a business not a charity.

Re: Moved house, can't get Virgin, but they won't let me terminate contact

I was in a similar situation earlier this year, was into the 2nd month of my 12 month contract when our landlord, decided to sell the property. Uber pain in the rectum time.

Got a quick move, but......the new flats where not cabled up, even though the street was.

First VM customer support, was just wanting me to stump up £250 notes or else. Was rather miffed at that response, especially if i had to pay 125 notes to BT.

One week later, BT said, the line is in, so all we have to do is enable it our end..so no charge...yipeee, Straight forward no probs.

Contacted VM again, to cancel and pay up my Cable contract, new person, then informed me, well you do know you can get Virgin ADSL on your new BT line. They then swapped my package over, NO CHARGE or cancelation fees:) But they did state it is a new 12 month contract. I can live with that, as it saved me 250 notes. Even if i did stop my new contract it would be far less than, paying up my cable one.

So happy bunny time, that I saved money and kept some sort of internet access. Scartchy at times yes,so are most of the standard ADSL firms.

It does not say that you can't move. It does however say that if you move and don't carry on with services, THEN you have terminated your contract.

Re: Moved house, can't get Virgin, but they won't let me terminate contact

This is the unfair bank charges thread, just applied to a different scenario of Virgin Media cancellation.

Just because something is written into a contract, does not mean that it is indeed fair and legal with regard to other legislation. A company may well have had lawyers pour over the contract, but unless it get's tested by a court, they don't really know do they. After all whenever a case goes to court there is usually a winning and loosing lawyer.

Bottom line, most VM customers just roll over when confonted with a big corporation claiming it's lost out.

I reiterate that whilst there may be some charges to pay, they should relate only to the actual losses being incurred by the cancellation, and that in no way should equate to the full unused contract price.

If it did equate Virgin would effectively be saying that they operate at a loss. Oh hang on, maybe that's why there are so many comments about poor network investment, STM and the like :(

And I say again, they don't

You take out a contract for the VIP @ £85 per month for 12 months.

You cancel six months in. You would be charged £10 per service per month till the end of the contract (unless that services costs less than £10). So you would have a fee of £180 (6 x £30).

If Virgin were to charge the full unused contract price the fee would be £510 (6 x £85)

You cancel the 3 for £20 after six months you would be charged 6 x £20 (£120) rather than 6 x £30 (£180) as the TV part of the bundle costs less than £10 as part of the contract

Unfortunately, what your are saying Ben, and what customers who are cancellinig ar being told by Virgin Media call centre staff, contradicts according to posts made earlier in this thread, and elsewhere. Looks to me like there is some additional training needed somewhere.

The teams that deal with disconnection, i.e. Customer Relations and House Moves, have a calculator that works it out for them. You put in the services, how long the contract has left to run etc and it gives you an EDF amount.

How many people here signed anything ? I know I didnt, all the agreements, all the deals, all the prices, all the terms done over the phone.

Wasnt me, must have been someone in my house winding them up :)

Ring them up and speak nice, if that fails, ring up again, eventually you will get someone who will do it :)

You don't have to sign anything to agree a new deal. In fact the Distance Selling Regulations say you can do a deal on the phone, and only if you then DON'T want it, that is when you have to sign a letter.

No you won't, because anyone that does not apply the early disconnection fee is breaking company policy, which means they will get sacked.

The thing is, while its nice to get advice here, at the end of the day this is not VM and while there are VM staff here, they dont represent the company in any way, and what they are saying is just an opinion, with nothing to back it up.

It dont matter what the script says, people are getting good deals, probably not from VM staff that visit this forum, but they are getting them, and contradicting everything thats been said here.

In that case, why would anyone bother to ask anything on the forum in the first place? Usually it is because they have not got the correct answer from Virgin, for whatever reason.

Also, I think on balance you would find the staff that post here (in their own time) are the the ones that have a better idea of what is supposed to happen than others.

Personally, whenever I try to help people, it is NOT 'opinion' I offer but fact, based upon what I know to be true. Whether people like the truth, or decide to ignore it, is not up to me

Yes, customers who stay with Virgin may be offered better pricing than usual. If they stay.

This thread is about people who don't stay and who break contract with Virgin. Why would you think Virgin would offer a 'deal' for that?

I am not trying to stir up any trouble, but it does get me very annoyed (whether on here or in other circumstances ;) ) when people say what I tell them is a lie

What suppose to happen, and what your saying are miles apart. You do not own VM, and do not represent VM in the forum in any way shape or form, your presenting yourself as someone who thinks they can put forward VM official responce

Your not official at all, your giving people the impression that what you say is 100% its not !

The only way to get the correct information, is to ring VM and not from you

BenMcr 29-06-2008 16:09

Re: Moved house, can't get Virgin, but they won't let me terminate contact

I would agree that the only way to get an official answer from VM is to phone them.

However you argue that even if someone were to phone Virgin and get an official answer, if they don't like the answer they are given, to keep on phoning.
Quote:

Ring them up and speak nice, if that fails, ring up again, eventually you will get someone who will do it
So whether the answer is official or unofficial you don't want to agree with it unless it is the answer you were expecting in the first place

I have also never said I am giving official advice, but why ask questions on this forums if you don't expect to get a useful answer? There is no point in this being here if it is just going 'have you done this?' or 'has this happened' and getting either a 'Yes' or 'No' answer

Also as an aside all th etalk of unfair contract terms in the case of the OP is slightly irrelevant

VM, like most ISP and Telephone providers are signed up to third party arbitration (CISAS and OTELO) and in such any court would expect that these routes are used first ( courts don't like their time being wasteed by what they would consider petty matters even if you consider them rightly more important )

CISAS and OTELO , when played to its full conclusion by the companies (I know as I used it to get out of a vodaphone contract mid term) takes about 4-6 months during which time you continue to pay for the service. if you are succesful the decision is not retrospective so to recover the monies paid out you then have to use the courts probably small claim courts where you would face their legal team against you ( no point in having legal represeanttion as legal fees cannot be recovered from the other party and they would be more than your claim if you won 100%) and I would say your chances of winning would be less than 15%

in reference to the new 12 month contract you should be protected by the distance selling act, I believe its a 14 day time to bailout of the new contract so then you would be left with the other 3 month sof the old contract.

Sorry just a question - you sign up for Virgin cable - not adsl then you move and they force you to take out their adsl service which is not the same as the cable service?

Thats unfair in any form of contract and they cannot enforce this on to you, especially if the move is out of your hands.

Another example of how this company thinks and believes its above the law, cancel any DD you have with them and let them take you to court, you will find they lose out in this. Plus if they moved you on to the new contract without explaining what the contract is this is again grounds for termination as you were not given the full facts of what you was entering into before they signed you up.

Argue away but contract law is plain and simple and its about time VM actually employed people who learned it, not just people who quote VM's ever changing to suit their needs T&C's!

Virgin charge you a early disconnection fee when you disconnect your cable account. Same as they do if you move abroad.

However because you are continuing with ADSL services (which I agree are not the same), they then refund the fee.

You are not forced to do anything

Rubbish, cancelling a DD does not put you in breach of anything. And besides, how can you steal something you pay for in advance anyway?

Hmm, maybe VM are stealing from me, maybe THEY are in breach of contract? Judging by the amount of cockups they make on customer bills on a monthly basis I say they are.

How does cancelling that put you in breach of any contract? if Virgin continue to supply you with a service after you refuse to pay for it then thats their problem not yours. I'd send the boxes and everything else back to them so they know I no longer want the service, how would I be stealing then considering I wouldn't have access to their service?

And the fact that Virgin refund the disconnection fee if you take out ADSL is just another way of getting you to stick with their crap service which is traffic managed again. One question if you move abroad how are the pathetic idiots at VM ever going to chase you for payment? it costs more to trace people abroad and attempt any form of recovery so methinks you just say I am moving to Botswana shove ya fee and then ignore any correspondence from them.

Well I thought the contract was a two way thing, Virgin supply services at the adress that you asked them. In return you pay them for it. If either of those two things don't happen, sounds like a broken contract to me.

If you included a note with the returned equipment advising that you wished to terminate the service then you wouldn't be stealing, as you had given the required notice

Er, its actually calls business. Of course Virgin are going to offer an incentive to those people who stay with the company.

I doubt they could, but as has been said, it would impact your credit rating within the UK. But Virgin will still try and chase it, and then turn it over to a recovery agency. So if you are still in the UK you would be found eventually

You are obliged to pay them for the service.

Because you are taking a service which you are not paying for, and by wilfully cancelling your DD have no intention of paying for.

If you go into Tesco and walk out with a bottle of vodka without paying, and have no intention of paying for, that is stealing. So why is it any different not paying for a month's BB or something?

If the bill is wrong, then you are (not) paying for services which you are (not) receiving (the option in brackets is because a wrong bill can work either way) and so you are either entitled to a rebate of the difference or required to pay for the services you have used.

Then you correspond in writing sending them a properly WRITTEN notice of cancellation using a guaranteed delivery service informing them that you are giving them x months' notice of cancellation and that once the contract is concluded you will be cancelling the DD. Don't just do it - that puts you in breach not them, and is not advised by consumer protection experts eg Watchdog, CAG, MSE, and the lawyers who write for magazines etc.

That is slightly different since they have the equipment, but presumably they collect this anyway once you have agreed a cancellation.

If they continue to take money from you when they are not seeking recompense for providing you with a service then that's them stealing - effectively it's unauthorised transactions, if that's not fraud you are still entitled to that back through the DDG anyway.

I'm pretty sure the ADSL is under separate terms and a new contract, so this waiving of a fee is just a goodwill gesture.

Ahh but you see, you claim that cancelling your DD alone is a breach of contract. I say not so.

Credit card payments and other forms are surely still ok? VM have screwed up my bill so many times I, and I am quite right to do so, no longer trusted them with MY bank details.

If anyone has a key to my bank account I'll make sure its never VM.

A 12 month contract is just that - If you leave after 6 months VM more than likely make a loss overall. Its a business not a charity.

It cost at the time about £800 per property to put in the up to the driveway infrastructure. This is however vm's infrastructure which they put in place regardless of and service being taken up.

If your talking about broadband then a cable modem is around £10, a Digital tv stb is £100 (which you rent so do not purchase). Installation in total is less than £150. (Educated guess)

Broadband admin costs are a pittance and vm make a lot of money on it, telephone also makes good money and digital tv makes some.

It only seems to be telecom and broadband providers that insist on 12 month contracts (and sky). I'm free to change my electricity and gas to move with the best deals.

Oh and I left vm 3 months into the contract (twice) and was not charged both times :-) (and both times I was not staff).

That doesn't look like cancelling a DD and paying through CC or cheque, that purely and simply is not paying for services whilst under a contractual obligation to do so, which IS a breach.

A certain degree of assumption is required when making any point which is down to the intelligence of the reader to work out. If the reader isn't intelligent enough to then why should one adjust to the lowest level? Or caveman speak?

To be honest it doesn't really matter what other companies may or may not do.

Virgin contracts are for a supply of services at a specified address, with no guarantee of any forward transfer. It doesn't matter where you move, if you end the contract within the minimum term, Virgin charge an early disconnection fee.

If, and only if, Virgin then supply you with services at the address you move to, under a new minimum term contract, will the fee from your previous agreement be waived

Hi!

Im not sure if this has been touched on yet...but as with all VM contracts...If you move to a non-cabled area and take beyond cable service any early disconnection fees will be waivered, but they will be charged initially.

I understand where you're coming from on this one, but they do put it in the T&C's about these charges so taking beyond cable may be your only option if you want the EDF's refunded

What relevance does that have? Ken Clarke supports Forest and he successfully ran the economy for years before the red crew ruined it.

Just out of interest, as I'm leaving my (not quite ex) can I transfer my virgin account to her and thus not pay the disconnection fee?

Yes, as long as they have been in the property over 6 months. There would be a £20 transfer fee, and they would start a new 12 month contract

Another question if you don't mind :)

If I transfer to the virgin adsl service do I get to keep my @ntlworld email address or do I have to have a new one?
