Welcome. Firstly... it's Virgin, and no they are not in breach of contract as they reserve the right to change channels in packages.

Re: i hate vergin media how do i quit?

Simple, call customer service and cancel.

Virgin Media have said they will not tie up any customer in a contract IF they cancel before the end of March this year.

Hugh 04-03-2007 12:02

Re: i hate vergin media how do i quit?

And also, they have stated that if anyone wants to leave because of the loss of channels, they may (as long as you do it before the end of March 2007).

Take a chill pill.

Zeph, as I posted earlier, a professor in law would beg to differ on that stance, he was on working lunch on friday just gone, you can catch up with it on the website :)

Didn't see that, but they reserve the right to change channels they carry in different packages, so would dropping 4 or 5 channels really constitute breach of contract?

You could watch it yourself, but he said that he would view it as a breach of contract.
Which may partially explain VM's current position regarding letting customers go.

Isn't that the beauty of lawyer-speak? He didn't say it was a breach of contract, he said he would view it as a breach of contract (his interpretation of contract law). I am sure some other lawyer would be more than willing to take someone's money to provide a different interpretation, and then fight it out in court (at more cost).

yes according to NCC

Qoute from here
http://www.cableforum.co.uk/article/...annels-dispute

"The NCC also insisted that Virgin Media confirms without delay, if its customers are entitled to cancel without penalty."

and trading standards said much the same

Not quite if you read it through

"the withdrawal of Sky’s basic channels does not breach our agreement with customers. However, if any of our TV customers wish to cancel their contract, we will allow them to do so at any time up to the end of March."

So it's a goodwill thing basically.

I think we should rename the site Snobs.com. Who do I call to make it happen?

Hee. In fairness, I see the point - but the original poster probably doesn't care what the company is called. He/she just wanted advice. People coming to bash newbies I find equally as annoying as poor spelling posts.

if you cancel the tv, you may well lose the discounts that you have on your account if any, as these would more than likely be agreed with the condition you are taking the tv aswel.

Is it just me or are quite a lot of peope that are full of rubbish. They are all saying that they only agreed to have cable if they provided Sky One.

We should do a vote and see how many people actually said oh yes i'll have the tv installed but only if you garauntee me that you will provide Sky one. Who asks that type of question.

Well there are a number of people who apparently burst into tears when Sky One was pulled off Virgin Media....

Re: i hate vergin media how do i quit?

Well for me personally, i couldn't care less for Sky 1. I never really watched it when i had sky.
Virgin Media is still the cheapest option IMO for what i need compared to what i had.

Besides, if people wait a couple of months, then they will find that Five, E4 or Living will show all the shows that are on Sky1.

It's the loss of a couple of channels that pretty much spend most of their time showing repeats.

Maybe VM should return the dirty play of Sky and go straight to the horses mouth and poach the top programmes, after all, that's exactly what sky did with Lost from E4.

shugdot 05-03-2007 08:50

Re: i hate vergin media how do i quit?

I was due to upgrade to a VIP package next week but on Saturday I phoned CS to see what my position was in regard to their T&Cs about any future changes in the channels offered (I did mention the loss of Sky One and Sky News and how the inevitable loss of these channels was known to VM during the rebranding celebrations) and I was so hacked off by the attitude of the person I spoke to that I cancelled the upgrade. She even asked if I was ready to cancel the TV service. That's what I call good customer relations. I am now studying what Sky has to offer though I doubt if I could be bothered with the hassle of having to paying BT for line rental. There are a couple of programmes on Sky One I like but the main reason for the proposed upgrade was the V+ box and the 2nd box in another room. I can live without them and save the £20 plus to spend on other things.

Graham M 05-03-2007 08:51

Re: i hate vergin media how do i quit?

Why would you have to pay BT for Line Rental (don't you have an NTL Landline?)

shugdot 05-03-2007 09:04

Re: i hate vergin media how do i quit?

Yes but if I went to Sky I would probably go for their BB. I am sure if I had said that I wanted to cancel the TV service the next question I would have been asked is whether I wanted to cancel the phone as well.

At the end of the day a court would decide whether the contact is unfair, and whether VM have broken it, he said basically that he would take the opposite view that VM are taking.
And by the way, have you not heard of the small claims court?
The customer would pay a court fee, once the case has been heard, if it went that far :erm: vm would have to pay the customers court fee plus compensation the customer is seeking.

Can you see in reality VM pressing that suicide button?
Ok lets say I have been heavily discounted under NTL.
I call up to cancel the tv due to the loss of sky 1 etc;
The cs responds, " I see that you are on a discount of £x per month, we are going to have to take that discount from your account if you cancel the tv "
As vickie pollard would say " wotever " :erm:

That link is worth jack you know what if someone goes to a small claims court over it.
A contract has to be seen as fair.
A court would decide that.
Surely you are intelligent enough to know that?

Theres little to miss, just be patient and all will be ok!

I love the Simpsons, and missing one new episode on a Sunday is no big loss, you can still view on Channel 4.

You're paying for a service yes, but with Virgin. The channels that have gone are Sky's, and you would have to pay more if you wanted them. With Virgin, you don't pay for a new box, you don't pay for a technician visit.

If you move to Sky, would you be willing to pay so much, just for a few missing channels, which programmes will be covered on Virgin Central anyway????

£299 plus £10 a month for a Sky HD box, compared to £10 per month (based on XL TV package) with Virgin Media... plus as you say, after the first year, engineer visits and repair costs. So you have to factor in depreciation and replacement of the Sky HD box when working out costs.

quite right nothing unfair with the conditions there

however their use of the word "significant"

Main Entry: sig·nif·iÃƒÆ ’‚·cant
Pronunciation: -k&nt
Function: adjective
Etymology: Latin significant-, significans, present participle of significare to signify
1 : having meaning; especially : SUGGESTIVE <a significant glance>
2 a : having or likely to have influence or effect : IMPORTANT <a significant piece of legislation>; also : of a noticeably or measurably large amount <a significant number of layoffs> <producing significant profits> b : probably caused by something other than mere chance <statistically significant correlation between vitamin deficiency and disease>

i sujest that the man on the clapham common omnibus would say that taking away the highest rating non terrestrial channel in the pack was something likely to have influence

I was under the impression that Sky withdrew the channels because Virgin refused to pay over the odds for mainly one channel, (Sky One), this seems the one most gripes are about, can this possibly be construed as breach of contract?

I have been on NTL for over 2 years. I signed a contract with NTL not Virgin. do I have any legal footing to fight Virgin as I did not have a contract to sign. they took over my Broadband and telephone. my broadband has suffered and now is often unaccesible. Why are Virgin able to take over my contract without my agreement. I do not like Virgin I have never wanted Virgin yet I seem to be stuck with them. Anyone please let me know of any other cable company I can sign with that does not require a BT line.

Even on the forums in the have your say area I posted 11 complaints I never swore yet none of them where posted, 90% are all in favour of Virgin. while the people that are not happy get cut by the censors. Thank you Virgin but no thank you, I would rather do without broadband then have you as my ISP. Worst company I have ever dealt with, one that forces you to switch to them without them offering you a contract, purely criminal. One last thing, Virgin are terrible at dealing with complaints. after Emailing the company a number of times and being kept waiting on the telephone I have pretty much given up all hope in getting a reply to my complaints.

Virgin rebranding NTL:Telewest is not the reason your broadband has suffered they haven't changed anything. Lota of people here who may be able to help with your broadband problems.

If you are not in your first 12 months of your contract just ring them up and give them your 30 days notice.

I don't think you can cancel contracts just because a company has rebranded.
I'm sure there other people can reasons in law why you can't. Not sure I could be wrong

Virgin have not taken over your contract, all that has happened is that NTL have rebranded their company to use the Virgin name (which they bought).
It is still the same company, infrastructure, etc, etc.

Over 2 years with NTL no broadband problems what so ever. first week of this so called re-branding broadband is suffering Coincidence? I want to cancel my contract but I need to know if there is another broadband service out there that does not require a BT line. I only needed to call NTL 3 times in my time with them and all my problems where sorted with little effort calling Virgin is a joke, seems they re-branded the staff to. For this Month only you are able to break your Virgin contract no matter how long you have been with them. A good chance to ditch this company with it's megalomaniac leader.

Nobody took over your contract. NTL took over TW and then NTL plc changed their name to VM plc (or whatever) your contract is still with the same entity. In any case there is a contract novation clause that would allow them to move the contract.
You can fight them on the existing contract, it is still valid just because the company name changes does not change anything.

Cable is Cable, there is only one cable company in the UK now, that is Virgin.

Oh well looks like ill have to get BT, Virgin or NTL or whoever the company is now puts the price of my broadband up without telling me and its slows down. I hate BT, ripp off prices but I detest Virgin more. as a Sky customer for over 8 years I can get 16 meg Broadband, free wireless router and no charge for set up for £10.00 monthly only fault I need BT. Oh well bye Virgin or NTL or who ever it is.

as a potential future representative of the BBU - Bridge Builders Union, can I register a possible grievance, which I retain the right to invoke at a future date, in that your irrefutable logic may be in 'restraint of trade' , where it concerns my members :D

I missed it, but Toto nailed this thread by Post 3. I guess we are not in Kansas anymore.

How did he Nail it? Been trying to get through to Virgin for ages on the telephone no luck, sent many Emails no answer. so calling and cancelling does not seem to work. So the topic of the thread is by no means Nailed.

Ok then - write. That would work too, send it recorded delivery and in 2 days time they have recieved your 30 days notice to cancel.

I refuse to spend good money on recorded letters. what I think i'll do is just cancel my direct debits, not pay this months bills. let Dick Turnip and his merry band of Morons track me down. If I go to court then at least I can have my say and speak to Virgin there.

Virgin seems an apt name for that company, so poor is their organization seems like they have been in business for a small amount of time.

Alan.

Re: I hate Virgin Media, how do I quit?

You can do that, but of course before then they will have Mooorcroft on your case and your credit record will be trashed so you won't be able to get credit cards, mobile phones, sky etc and lets hope you have no plans to move or remortgage.
You could just stick a second class stamp on it. I just suggested recorded to have proof you cancelled when they claim the item was lost in the mail.
Your actions do not cancel the contract, they merely breach it.

Recorded delivery only costs an extra 68p on top of the price of a 1st or 2nd class stamp..................very cheap, & much better than trying to cancel by phone or (shudder) email.

As SMH said, cancelling your DDs etc is not cancelling the contract.... you would find yourself being chased by the debt collectors, get a crappy credit record, & maybe even wind up with a CCJ......

Cheers guys, I will send off by post. One last word, Virgin is supposedly one of the biggest multi media companies yet to contact them you have to use one of the oldest forms of communication, post, the Irony is not lost on me. Thanks again for the help.

Wel I jumped ship today and it was seemless, easy and manned by extemly polite and helpfull staff.. By next week I will be able to watch the programmes of my choice at a much cheaper price.

It is very sad that it has come to this , but at the end of the day, the customer is always right.

That, apparently, wasn't true in the relationship between Sky and Virgin Media :D

I managed to cancel Virgin today by phoning 150 and evenually getting the cancellation ofice. After waiting on the phone for 53 minutes and 11 seconds I finally got to speak to a human being. She did try to pursade me to stay but my mind was made up.

So, just keep hanging on the telephone.

That's really strange - everytime I've called CS about things, it's been no more than five minutes.

That's really strange - everytime I've called CS about things, it's been no more than five minutes.

Thats because your a happy Virgin Media Customer, they can sense on the phone if your annoyed at them and leave you on hold. Last time I phoned them I was left on hold for 57 mins then I disconnected, the Only customer services that come close to virgin Media was Tiny Computers I was left on hold once 3 hours while trying in Vein to get the money back for my Daughter's PC no luck there. So if am I am kept waiting over a certian time on phone now I dissconect.

Supplier = Sky
Customer = Virgin Media

I guess there's nothing much else to do whilst you're hanging on the phone for almost an hour.

And the profileration of phones these days with a minutes and seconds timer on does kind work against those that like to keep their customers on-hold for too long.

Sorry to be so pedantic Bill, but sitting with telephone, clamped to my ear, playing a horrid rooty tooty tune is not what I enjoy doing on my day off. The fact that i had tried the night before and had been cut offdid not help matters.
