Rape Claim Wife gets 12 months

I hate it when women do this. It's dispicable and a slap in the face for real rape victims. :(

LINK

I think she got off very lightly myself.

My sympathies to her husband, the formerly accused man and her child.

Has anyone here been the victim of such slurs and slanders?

Absolutely despicable. She deserves way more than 12 months considering that if the guy was convicted, he would have done 12 years, and basically had his life ruined. Sex offenders don't exactly get an easy life inside or outside of jail.

This is my worst nightmare, and way too common. 12 months will be nothing to her :(

just another example where the law is an ass.

especially in these cases, where the accuser remains anomonous and the mans name is plastered all over the media whether he is guilty or not.

That surely needs to be changed.

I wonder: if the alleged gang rape had been poosted on the forum when it occurred, how many people would have expressed an opinion that the man charged with it should have been strung up. Just as well the 'victim' eventually got him off the hook, eh?

Still, no smoke without fire, I bet he's a bad'un really ... :erm: :grind:

But it wasn't posted here. The case wasn't publicised in the news, as far as I can recall - so perhaps the Police smelled a rat from the outset?

very sarcastic post from you there chris (did someone get out the wrong side of the bed?).... but the sentiments make perfect sense. we've always said that we have emotive responses to news articles, it is the human way.

i guess this poor guy has learnt some lessons as well though... like picking up women in bars and having one night stands properly is not the best way to act.

It's very easy to jump to conclusions and very easy to typecast without knowing the full circumstances isn't it?

yes it is, maybe we should all learn from this never to take on face value everything the media claims (although as someone said maybe the original allegations were publised)

I have no reason to doubt that the man who was initially accused of rape is completely innocent not just of this crime but of any other sex crime. I was being sarcastic. I should do it more often, seeing as this little outburst of irony has confused so many people :D

What I'm trying to say is, we have here a classic case of someone being accused of the kind of crime that usually gets the pitchfork-weilding mob out in force. That accusation is later found to be baseless. Yet, if the initial accusation had been posted here, that man would doubtless have been hung, drawn and quartered, in a literary sense, within minutes.

I can't believe someone could be so cruel, this mans life has probably been ruined because of this!!

Can you imagine forgetting all about the woman, then being dragged out of bed by the police, and not knowing why?!

Which is why I tend only to post such cases AFTER they have been to court, and judgment passed by the judiciary. ;)

To the topic ... I tend to think she should have gone down for rather longer than she did. Perhaps sentencing in these cases should take account of the likely consequences for the innocent person, had they been found guilty.

Above all, though, I feel for the two-year-old son, who's mother is a jailed sex maniac and whose biological father is an anonymous one-night-stand. He probably will be better off with the father he has, but boy, what a load of baggage he's eventually going to have to carry. :(

You're asking for a lot there ;)

I really feel sorry for the "accused", as he has probably taken a lot of abuse already for being labelled a rapist.

Like Pierre said earlier, both parties should remain anonymous until the end.

hey you'll only have me admit it once....

unfortunately, it seems to always be the kids that are eventually effected in these cases, sometimes i really wonder whether some should be sterilised to stop them bringing children into the world who will get screwed up.... but yes i know it isnt very humane or PC of me to say that

Sorry, but how sanctimonious can you get? People react in different ways.
I feel terribly sorry for the guyt that this happened to, and the slut deserved an awful lot more than 12 months...

But regardless, if one of your daughters come home claiming she'd been raped, what would you say? 'I'm sorry you're distressed sweeheart, but I'll reserve judgement on whether you're telling the truth or not til it's gone to court. And even then, if the alleged rapist gets convicted, I'd be happier to wait for him to appeal and get the results of that, just so I know for sure.... '

i personally wouldn't call what chris said "sanctimonious" or in fact anything he implied. rather what he did say was not to wait to pass judgement when someone claims to be raped but that we need to think about the media coverage and that we aren't presented with all the facts.

Of course if it happens close to you, you will be angry (and rightly so), and emotionally involved. Besides, you will have access to more of the 'facts', than the average person reading the newspaper reports (including knowing the character of the (alleged) victim. I think what Chris is calling for, is for those who are not emotionally involved/further removed from the case to pass judgment on a case where they are fully aware they are not armed with the full facts.

You've completely changed the focus from 'whether the accused man is guilty or not' to 'whether the victim is telling the truth or not'. These are not the same thing, and making the mistake of believing that they are causes no end of problems. Believe it or not, it is possible to be supportive of a victim of serious crime while resisting the urge to do harm to the person alleged to have committed the crime.

The problem is that many men are charged with rape and sexual harassment when no such offence has been commited. Even if they are found innocent there are many people who adopt the "no smoke without fire" attitude which tends to stick with them throughout their life. It is very easy for a woman to cry rape and very hard to prove that rape hasn't taken place, particularly if some time has elapsed between the alleged rape and when it is first reported. I wonder what the verdict would have been if the accuser hadn't changed her plea at the last minute and decided to stick with her claim?

It would appear that there could be something like 46,000 alleged rapes a year http://www.femalefirst.co.uk/health/1832004.htm but few get reported in the national press. Cases like this are more newsworthy because it is a false claim with a resultant jail sentance.

OB,Chris is just pointing out that on CF we sometimes jump to conclusions when perhaps we haven't got all the facts.

I personaly think we would be better off discussing cases that have had a judgement passed down on them and sentenced pronounced.Much safer. ;)

If I read what you posted correctly, I think you are comparing Apples and Oranges. Chris' post was having a go at those on this forum who like to leap in and say "burn the criminal" without reading the full facts. Something I have noticed a lot recently. Thus, he is talking about what a bunch of people, who may have no real knowledge apart from what they read or see on Telly.

You are talking about a person experiencing rape, then going to a family member. Now, they would be extremely distraught, in shock, or a good actor. There may also be some physical evidence of the rape (torn clothes, bruising etc). Combine that with the fact that you may well know the person, and that 99.9% of people would not cry Rape falsely, and you will see that the actions of a few random forum members (who may or may not have experienced rape) who have read either forum posts, or one article, cannot be compared with the actions of someone who has experienced Rape.

I'm going to go one further than Bex and say Chris is absolutely right on all counts and deserves immediate enrolment in the CF Hall of Fame and, when science allows, to be the father of my future children. Or is that a bit over the top? :)

Terrible case; devious, selfish and irresponsible woman. But as Ian, I think, pointed out, newsworthy due to its unusual nature. But were rape so unnewsworthy.

No, but as I keep pointing out, that's why we have an independant Judiciary and Juries to avoid the "lynch mob" mentality.

Re: Rape Claim Wife gets 12 months

Sorry OB, but I have to agree with Chris on this one - it's not about the way the family should react, but about the way we should react. And I see that some CF members (including me, I have to confess) are quicker to air their opinions than Roberto on BB ..... ;)

On the broader issue of anonymity in rape cases, as ever there's no right answer, just answers that aren't as wrong or as badly wrong in as many cases, if you see what I mean.

Anonymity for alleged perpertrator: good if you're falsely accused and aquitted, bad if you did the crime but get off with it and as a result other victims don't get to add their evidence.

Anonymity for alleged victim: good if you really were the victim and can't face being a victim again, bad if you're making it up and other people you've 'accused' can't add their evidence.

Now, very few accusations of rape are false, so you might think that 'no' and 'yes' respectively are the answers, but the problem with that is that the bads for 'no' and 'yes' are so extremely bad to make it less easy to decide.

I've just reread my last 3 paragraphs and they're crap aren't they? :dunce: - I've had a hard day at work - can anyone translate into English?

I think one of the points to note in this is how well the woman manipulated society's automatic tendancy to believe females in cases like this.

No doubt in many times this is correct however to approach all 'rape' scenarios as if the woman is 'obviously' going to be telling the truth is dangerous.

Just an afterthought: what if the guy she accused had been a premiership footballer

I wouldn't want anyone to think I'm playing down the disgusting act of rape, or the trauma involved. In my mind her sentence should of been longer than the guy would of got for rape, had he been guilty. This woman was prepared to go to let an innocent person go to prison for a crime he didn't commit, surely her sentence should be equal or greater than that of a guilty rapist.

Stuart 07-06-2005 22:36

Re: Rape Claim Wife gets 12 months

They have to strike a balance. If they sentence a woman too harshly for this crime, they risk putting other (genuine) rape victims off (in case they are prosecuted). If they don't sentence harshly enough, the woman would be seen to have got away with it.

I agree, this was sick. However I think it is a question of balance to ensure real rape victims come forwards. She has properly lost her family, has lost her reputation, and has been has all the details for her horrible crime released to the public, so that is at least something

I think this again shows the need for total media blackout from reporting cases involving rape, it is NOT in the public interest. So in cases like this the mens reputation isnt ruined. Also she could get the time she deserves.
