no more r18 pornos over the net

Re: no more r18 pornos over the net
I can understand there point but what if someone legally wishes to buy porn, but does not wish to in person.
I can see Kazaalite and Bittorrent getting busy then. |
Re: no more r18 pornos over the net
i think overall the amount of stupidity that resides in the judicial process has reared its ugly head, obviously these judges have not heard of the internet, and ofcourse online shopping to aquire the taste of content.
i think its blatantly a load of nonsense its not going to stop black market imports and its certainly not going to stop consumers purchasing from abroad. |
Re: no more r18 pornos over the net
Could someone let me know when this law comes in so that I can get a large order of porn in beforehand :D
Nanny state, anyone  |

|
Re: no more r18 pornos over the net
Exactly.....
They are not going to stop it in the slightest. The stupidity of these people amazes me. Now I'm off to watch some more free hardcore R18 porn from sites not in the UK. |
Re: no more r18 pornos over the net
I was reading an article the other day that claimed that young teenagers were engaging in unprotected group sex. How would them viewing an R18 video by bad, other than to possibily educate them in the use of condoms?

Interesting thing, our attittude to porno. You can be 16 to have sex, but to watch it, you have to be 18. So for 2 years you have to have sex with your eyes closed. No doubt the omnipresent government would be on hand to supervise and making sure the youth aren't being corruptted by seeing each other's genitals aged 17. |

Speaking as someone who's connected with this industry, this decision is a total nonsense. Yes, it may stop kiddes buying hardcore DVDs through the post, but given the amount of stuff that's already available for free, it's really going to have damn all effect in "protecting" (hah!) them. As for the fines, they're a joke, given the size of organisations like Pabo and Interfact, they're not even a slap on the wrist, but more of just a wagged finger. There is a magazine called ETO (Erotic Trade Only) which, unsurprisingly, is a trade magazine for the adult industries and this has been discussed a fair bit in there recently and the companies involved have already stated that if they lost they would take it to the House of Lords and the European Court. But in all honesty it doesn't matter a damn because the decision is only going to stop companies in this country from adverting R18 DVDs on websites *based in the UK*, it can't do anything about those abroad. Yes, ok, it could still be argued that they are "sending obscene material through the post" but unless HM C&E start opening loads of mail, they're not going to have any effect. Paging King Canute...! * * Yes, I *know* he didn't actually say he *could* turn back the tide and he was just demonstrating to sycophantic courtiers that he wasn't as powerful as God, but you know what I mean...! :) __________________ Quote:

Re: no more r18 pornos over the net
But people do use porn as an ideas source for having a bit of fun, anyone using Bond films for similar purposes is looking at a conviction for dangerous driving at the least!

eg those Japanese shibari (rope bondage) pics look great with the girl suspended in mid-air, but what you don't see is the three or four assistants ready to step in and take the weight off her as soon as the picture has been taken. Re: no more r18 pornos over the net
The High Court ruling is simply a dismissal of a couple of appeals against an earlier decision taken against some suppliers...
AFAIK, the law has always been that R18 videos/DVDs can only be sold in person in a licensed sex shop. So does this ruling really change anything? Hmm, OK, apart from clarify judicial opinion on the existing law? [in any case, hopefully it will go to the Lords & they will overturn the High Court, seeing as the law is quite stupid] But, yes, it is a very stupid ruling.... it is perfectly legal to order - and have posted to you - hardcore porn via the 'net/mail-order, if you order from a foreign company. So why shouldn't adults be allowed to get the same stuff online/mail-order from British distributors? Quote:

However, anything which does not fit the BBFC's R18 guidelines is still classed as obscene, & is still prohibited from import & can be seized by Customs: Quote:

And, of course, there's the small matter that it costs *at least* £500 to get a 1 hour DVD certificated and if they decide you need to make cuts, you have to reapply and pay *again*! This means that the small "specialist" suppliers either have to risk breaking the law by selling uncertificated material or risk seeing whatever profit margins they may have wiped out by the costs involved :( |
Re: no more r18 pornos over the net
 Why do they show War films and films containing Graphic violence as the norm on Television, But they won`t show a film contining images of two consenting adults having sex in a loving fashion?

Re: no more r18 pornos over the net
It would help if Customs would clarify what exactly is illegal i.e. what they class as 'obscene', because it will come down to the judgement of whoever is assigned to open it. Therefore it becomes a lottery. On top of that, the goalposts keep changing. I remember like 10-20 years ago, visible penetration, (and I think errect penises) were considered obscene and seized, but they seemed to change their minds, and now they seem more worried about S&M related material.
It would be a lot more helpful if they can at least say: "X, Y and Z are legal, but A, B, C aren't". At least you'd know where you stood, even if they don't become more liberal with their attitudes to it (and they really should by now). |

eg "likely to encourage an interest in sexually abusive activity" involves a completely subjective opinion. How can anyone say "X, Y and Z will encourage someone to commit abuse" without reading their mind? It's not as if someone on the film will say "yeah, this is fun, go out and do it!" "Any form of physical restraint which prevents participants from indicating a withdrawal of consent." means that you cannot show ball gags in use, because they can't say "no" or use a Safe Word but this ignores the possibility of "Safe Signs". (The following link is to a page on my site and is thus for adults only, however it does not contain any explicit content, merely useful information on Safe Words and Safe Signs: I hope this is ok to post, but if anyone objects, please delete the link and people can PM me for the address) "the infliction of pain or physical harm, real or (in a sexual context) simulated. Some allowance may be made for mild consensual activity". How mild is "mild"? Again this is purely subjective. I know some people for whom a good thrashing with a cane is merely a gentle warm up! "Strong abuse, even if consensual, is unlikely to be acceptable." Why? Because the people who made the laws didn't like it? It's perfectly possible to go over to Amsterdam etc and buy hardcore BDSM films which show all of the above yet, somehow those "disgusting foreigners" have managed not to turn into complete sex maniacs... __________________ Quote:

I'm impressed at Graham knowing about safe signs - most people only think of safe words, but they're not likely to end up so restrained that they can't speak :D And I agree - one man's mild is another man's extreme. Same goes for vanilla. Who knows what goes on behind the net curtains of suburbia :D

Something I just thought about. Is material transferred to you via the Internet covered under this law? I.e. if I signed up to a BDSM web site, would that be illegal? And if not, what is the difference between downloading movies from the site and getting a hard :erm: copy?
|

The general rule is that anything that's illegal in real life is also illegal on the internet, however they have to catch you with it (eg Gary Glitter) before they can do anything about it. |
Re: no more r18 pornos over the net
I think Graham's right.
I think the offence would be something like "transmitting (or soliciting the transmission) of material considered to be obscene". I just made that up but you can guarentee there's a proper charge for it somewhere. I'm sure they'd make it stand up in court if they wanted to ;) |
Re: no more r18 pornos over the net
I can sort of subscribe to the argument that there should be no safe words or signs because the submissive one should trust the dominant one, who should know the needs and limits of the submissive one. Must surely be the highest level of intimacy to know what the other wants without him/her having to articulate it.
It's an education is CF :D |

Re: no more r18 pornos over the net
As I understand it, nothing has changed and it is just a ruling on UK based companies which have never been allowed to sell R18 movies via mail-order. If I am wrong about this then can someone please tell me. I have been getting R18 titles from companies based abroad for some time and I even had one opened by customs, who resealed it and sent it on because I was acting within the law, purchasing legal, licensed material for my own personal use.
The porn laws in this country are bizarre. As Matt said on page 3, what is the problem with regard to buying porn via mail order from abroad but yet you can't from within the UK? I can understand that there is a higher chance of the DVD being intercepted or opened by a minor for something sent in the post but given the fact that licensed sex shops aren't exactly many in number, and that gay licensed sex shops don't exist outside of London, Brighton, Birmingham and Manchester, I am all-but being denied the right as an adult to view legal material for my own personal use. I live in the third biggest city in the UK and the licensing body respoinsible for such matters has refused a gay store an r18 licence several tiems over several years (and raking in a five-figure sum each time) and this is preventing me from purchasing legal r18 material in person so I am forced to use the net to purchase said legal material. The porn laws are crazy in this country and, as said before, porn only became legal here following a challenge in autumn 2000 and thank goodness that challenge took place! |

Obscene publications guidelines have been quietly amended because the CPS is no longer willing to waste time and money prosecuting "obscenity" after they lost several cases and, of course, the advent of the internet means that unless something shown is clearly legal (eg child porn), it's just not worth them trying to get a conviction. http://observer.guardian.co.uk/sex/s...818537,00.html |

All I want to watch is legal and certified R18 DVDs which, as an adult, I am entitled to watch. I can't go and get it in person so am forced to sue the net to make my purchases of legal material. |
