Fraudently Took Money From Debit Card

Hello, What gives NTL the right to take money from my Partners Debit Card without her consent....if me or you did this we would be Arrested and face CRIMINAL charges and would probaly end up in prison.

My partner as taken Legal action against NTL and i would personally like to hear from anyone else who this as happend to, or anyone that as been RIPPED OFF by NTL and ended up in Financial HELL. I know that there will be People in the same Boat as ourselves that are on benefits of some sort.

I Myself have Heart Disease at the tender age of 40 and me and my partner have 4 Children the youngest being 2 in June, and all you good Citizens out there that are in the same boat as us will know where i am coming from.

I think it is time that people like NTL should not get away with ripping people off we have seen all the programs like House of horrors where people are named and shamed and that is my Intention with NTL....and i would love to hear from People that have been or are still NTL Customers on how they have been ripped off ....as my Intention is to get Concrete Evidence so i can get the Communications Agency to look into the Practices of NTL... after all from what my information from NTL themselves they are supposed to be American.

All you People out there lets fight back by standing up and fighting these rip-off merchants by standing together.

Re: Fraudently Took Money From Debit Card

Perhaps you'd be so good as to provide details of what you claim has happened rather than simply stating you've been ripped off. If I had a pound for every person I have dealt with who thought they had been ripped up when in reality they'd misunderstood their bill, I'd be rich.

Secondly there's no such thing as a 'communications agency'. There is the regulator, OFCOM, who you can contact, but who will only take up your case if you can demonstrate you have exhausted all channels of resolution with ntl. Otherwise they'll refer you back to them.

So, if you can post a bit more info, someone on here may be able to shed some light on what has happened and suggest the best course of action to get it sorted.

This what I really don't like, new members coming in shooting from the hip and only giving their side of the story.

Sorry if I sound rude and cold colin, you should never post when you are angry and I don't think NTL are particularly bothered about the state of your health or your personal life.

Are you sure that your partner hadn't set up an instruction that NTL could debit the money first without having to ask permission each month?

Sincere sympathies for for your illness but I dont see what that has to do with being "ripped off" as you put it.

Re: Fraudently Took Money From Debit Card

Hi,

What they have done is stored my Partners Debit card details on their System, as i used to give her the money to pay into her bank account to pay the NTL Bill
then i would phone NTL and pay for the service and then she would have to confirm that she was the Account holder and the card holder of the bank account.

But Ntl decided to take £120 from her bank account with no permission whatsoever from my partner....but she incurred alot of bank charges due to NTL unlawfully taking money from the account, and yes we do have a letter in black and white from NTL stating this also.

That is why our Solicitor as taken the case onboard... and to put you right there is a such thing as a Communications Agency where do you think the wireless and Telegraphy act of 1974 comes from....sorry if i sound Ignorant but i don't mean to be i am just a normal straight and blunt talking person....and by the way the communications agency does exist, i do not know you but should you happen to know any Licenced radio amatuers they will back up my clain that the communications agency exsists.

Not Angry not shooting from the hip...but my argument is why when i was with NTL and paid my bill every month that they should take money from my partners bank account unlawfully.

And to back up my claim we even got it in black and white from NTL stating the facts of which i have posted on this Forum.

Plus even being a new member or an old member i have the right to say what i feel i do belive that's what this website is about is it not.

Don't be sympathetic because this is a disease it's self, but if you read the thread properly and the replies i have written you will see that i am justified in the statement that i am making. Plus the fact i did state in my thread to start this forum, that i am interested in people in the same boat as me....and the replies i have had up to yet must be from Exsisting NTL Customers.

To put it straight how would you feel if i took money from all the Bank Accounts form the people in this Thread including yours.

Re: Fraudently Took Money From Debit Card

Sorry but I have no idea what you are going on about, OFCOM are NTL' BSKYB, British Telecoms, Telewest Etc's regulatory body, but if you have not exhausted all lines of resolution with NTL they wont touch you're claim.

And when you do speak to NTL try to be a bit more reasoned and clear about what the actual problem is.

poolking 26-03-2005 13:49

Re: Fraudently Took Money From Debit Card

I'm surprised that a solicitor has taken on your case, as you haven't stated whether you've exhausted all channels with NTL.

Also the 1974 Wireless and Telegraphy act has nothing to do with whether NTL should have taken money out of your partner's account or not, all that act is for is to make sure that you are licenced to use equipment that uses RF frequencies to obtain broadcasts and that the equipment you are using doesn't intefere with critical communications airwaves.

As already stated by gooner, the regulatory body that NTL and all other media companies have to answer to is OFCOM. That is the only "agency" in existence, they replaced OFTEL last year and have more broad ranging powers.

As gooner said, if you cannot demonstrate to OFCOM that you have exhausted all channels in this matter with NTL they'll just tell you to go back to NTL and try again.

Re: Fraudently Took Money From Debit Card

Hi Colin and :welcome: Regarding NTL ripping you off as you put it, I would doubt this very much.

While I would agree the Communications Agency does exist this would not be the body to get help with your problem, OFCOM are the ones as stated before.

I have seen a thread were a person had a debt with NTL and agreed to pay of this amount @ x amount each month plus their monthly payments for the services they had, this was going to be done by DD which they were advised would save a few pounds.

This person was on a tight budget like yourself being on benefit I think (canâ₠¬Ã¢â€žÂ¢t find the post) and when they got their bank statement NTL had taken 100% of the debt plus the monthly charge leaving the person with only a few pounds for the month to live on.

While I would be hopping mad if I were this person, I donââ‚Âà ‚¬ÃƒÂ¢Ã¢â‚¬Å¾Ã‚¢t know where they would stand in getting a refund for the money taken even if it was a communication problem.

You need to calm down and talk to CS billing on Tuesday, but a little bit of advise donââ‚Âà ‚¬ÃƒÂ¢Ã¢â‚¬Å¾Ã‚¢t attack the person who answers the phone as they may just dig their heels in and not help you.

If the above is nothing like your situation and NTL have just taken for services you donââ‚Âà ‚¬ÃƒÂ¢Ã¢â‚¬Å¾Ã‚¢t have again phone CS billing.

Scroting gave you some good advise in post 2

Hope you get your problem sorted.

Re: Fraudently Took Money From Debit Card

Sorry gooner but i dont think you you have read my replies to the good people that have replied to my thread. But to put it in laymans terms NTL took money unlawfully from my partners bank account with no written instruction from herself...and we have a letter from NTL saying what they had done is wrong.

Yes you are right on the Regulatory body...but who do you go too to sell Tabacco and wine & spirits...a solicitor to apply to the magistrates for licence.

And the same goes for communications, all communications have to go through the Radio Communications agencey to get a Licence to broadcast....Wheter it is CB Radio-Ham Telephony {Speech- Telephones) Ship to Shore Radio....Satellite Communications.

Even BT have an Communications Licence so does NTL....where does NTL buy it's Air time from BT....where does The Post Office buy it's air time from BT.

The Drama Queen told me there was know such thing as the Communications Agency...and you yourself know very little about communications....so i hope i have taught you a little lesson on the reply you put to my thread....replied to one person on here not shooting from the hip meaning (not shooting my mouth off) and i would just like to say i am a communications expert and i do know the difference between a governing body Oftell...Ofcom.....and The Radio Communications Agency.

Re: Fraudently Took Money From Debit Card

If you have a letter from ntl admitting liability, then this surely means the matter is being resolved.

Having money taken out of your account in error isn't necessarily a criminal matter. It's only criminal if there is deliberate intent. If it's a billing error, then it comes under different laws. The police certainly wouldn't get involved.

If ntl HAVE admitted liability, then the regulator would only get involved if the company still failed to rectify the matter.

As a precaution against anything in the future, get your bank to issue a new debit card to replace your old one, and only pay by DD in future...DD carries a 'gaurantee of indemnity', banks have to refund the payment within 48 hours if you raise an indemnity claim. It's much safer than continuous card authority.

Re: Fraudently Took Money From Debit Card

Thank you for proving me right on the point of the communications agency does exsist. Glad to see someone is on the same WAVELENGTH....but sorry to say we had know Debt with NTL....they just took the money anyway.

Does this make sense or do i have to scan the letter concerned and post this on my thread also....then maybe just maybe people will read what i have posted very carefully.

Many thanks for stating that there is a communications agency and you yourself must have some expertise in this field or maybe some knowledge.

Thank-you
Colin.

The 'Communications Agency' is to all intents and purposes the government's press office. What this has to do with NTL is anyone's guess :)

So who's been across the bridge today then ? ;)

So if you are saying that NTL have admitted liability, let them refund you, why the need to get a solicitor involved?

Re: Fraudently Took Money From Debit Card

Well because they have promised for 16 weeks or more and the person resonsible for this statement was A SUE Attenbourgh... oh and yes SUE is a credit control manager for NTL.

And like you have said (you must be a ntl customer) Because we have in it black and white that they accept what they have done is Illegal...so what is your argument.

A little :notopic: but the Communications Agency or better known as the Radio Communications Agency Link would be the people you would contact say if your next door neighbour had a computer that leaked RF and was causing you problems in Listening to the Radio or watching the TV or the radio ham next door was causing you problems.

One thing I didnâ₠¬Ã¢â€žÂ¢t know is they are under OFCOM and they merged in 1993 and came from over the bridge Waterloo Bridge that is, their old home. :)

Now whos got a leaking computer :D

The Radiocommunications Agency is PART of ofcom.

From http://www.ofcom.org.uk.

Quote:

Ofcom inherited the duties of the five regulators it replaced in December 2003 †“ the Broadcasting Standards Commission, the Independent Television Commission, Oftel, the Radio Authority and the Radiocommunications Agency.
Besides, you would only contact the radiocommunications department of ofcom IF ntl broadcasts were interfering with your own radio broadcasts.

Because NTL are a registered telecoms company, you need to contact ofcom's telecommunications department (there are numbers on the site above) to sort out any billing enquiries. You will need to make sure you have exhausted your channels at NTL first though.

I don't think she would appreciate her name being posted on here without her permission. I would try and contact the MD of ntl home, his details are listed in the knowledgebase if you aren't getting any joy.

I suggest you go and calm down before posting any further. Posting people's names on here without their permission is not the right way to go about things no matter how long this has dragged on for.

The communications agency just the governments press office....just shows how many people on here are very naive to communications.

What does this have to do with NTL....putting it bluntly this is who NTL have their Communications Licence With........and WHO's GOING BACK OVER THE BIRIDGE......I have had one decent E-Mail from a Couorled guy who as told me he knows about the communications agency.

So all you Devowed NTL Loving Customers please talk to me about something that you know about.

The Telecoms (voice and data) and Broadcast regulator for this country is OFCOM (OFfice of COMmunications). Can't find a website for any other communications agency. Unless the existance of this agency is classified (in which case, they would not licence a public company, and you could be charged as a traitor for talking about them), then there would be a website for them. Under the Freedom of Information act, their procedures and publications would certainly be required to be open for public review.

So, instead of telling us we are wrong, why not go to the right department within OFCOM?

I work in the department that refunds this type of payment "taken in error" presuming its sabs based, its usually boils down to either a csr added the card incorrectly,or there has been an issue where switch cards have been allowed to claim the full o/s bill, this being a software issue, ntl is fully aware of the problem and will without question refund the money back to the same card,as for charges once the evidence has been supplied this can also be refunded as a chq, cannot see the necessity for legal action unless the normal channels aint worked?

Re: Fraudently Took Money From Debit Card

My parent have 2 cards.

When our internet was disconected for no reason, NTL told us if we want it back we had to pay reconnecting fee £50. So my parent gave them a credit card number to pay that £50. They didnt reconnect the internet straight away. Then NTL said to stop this happening again, pay your monthly fees through credit card....(we payed through cheque). My parent gave them a different credit card for monthly fees.......this happened back December/January. (A month without internet then)

Guess what they did last month???........well NTL took £25 from two cards, (including the first one which was used to pay just £50 reconnecting fee). So they took £50 in total last month.:td:

ntl customer here, pay by direct debit, never had any problems.

Colin, whilst this site was originally formed as a forum for the many complaints that ntl generated because of their disjointed services, you will find now that in all cases peolpe here can point you in the right direction to complain. When people tell you that OFCOM are responsible for unresolved complaints, they are correct, they actually know what they are talking about...........in fact ntl's former CEO, Stephen Carter, is now the director of OFCOM.

As has already been mentioned, if you have evidence of liability from ntl, and they have not come good with their promises, take it up with OFCOM.

Re: Fraudently Took Money From Debit Card

My two cents...

Yes NTL sometimes do mistakes, as a longtime customer i have learnt to deal with this. The fact that you got a letter from NTl admitting Fault is a bonus!!! (Id Frame that if i where you!!!).

Anyway to settle the arguement
The Radio Communications Agency you where reffering to was The Radio Authority, the last five years The Radio Authority, OfTEL, and various media and regulatory bodies Merged into one super Regulator called OFCOM. So yes there is a communactaions agency but it is OFCOM.

OFCOM wouldnt normally deal with that kind of complaint. Your best bet is to contact your bank, finacial services authority or the police. Your are making a complaint of Fraud not of Tele/Visual/Audio/Data communications nature.

And thats my morning steam let off.
