From today's Guardian Legal pages:

"This item comes with a warning. It is legally fascinating and full of human emotion but not without its distasteful elements. It's about a new way of becoming a father, US-style. Here it is. Two doctors in Illinois have oral sex. Afterwards, Dr Sharon Irons, without telling Dr Richard Phillips, keeps the semen she took in orally and uses it to get pregnant. Two years later she brings a paternity suit against the unwitting sap, and wins a court order that he's the father; he now has to pay $800 a month upkeep for the child. (At least Bill Clinton escaped that.)

Phillips, understandably miffed at having to support the kid without even the pleasure of having been laid, returned to court with a wheeze of his own - accusing Irons of stealing his sperm and of causing him emotional distress, for which he demanded compensation. Her secret keeping of the semen was, Phillips said, a "calculated, profound personal betrayal"; he had trouble eating and sleeping and had "feelings of being trapped in a nightmare". His case was based on the premise that she had "deceitfully engaged in sexual acts, which no reasonable person would expect could result in pregnancy, to use the plaintiff's sperm in an unorthodox, unanticipated manner yielding extreme consequences".

Last week, an Illinois appeal court turned down his accusation of theft on her part and agreed with Irons's argument that, when he "delivered" his sperm to her, "it was a gift, an absolute and irrevocable transfer of title to property from a donor to a donee. There was no agreement that the original deposit [sic] would be returned upon request." (Is that "gift" tax-deductible, I wonder?) But the court did give him the go-ahead to pursue his claim for emotional distress."

If that is true, it is absolutely dispicable on the woman's part, but she is denying it, and saying it was the result of conventional sex. I am suprised the Guardian never said that ;) In that article though, it says that Irons agreed with Phillip's version of events? :confused:

I can quite easily imagine that happening here, and not just in the US.

That sounds like an excuse.

Having once (many years ago) been in a situation where I thought the decision had been taken out of my hands, I know how disturbing that feels.

I can understand that the law-makers never envisaged such a situation ocurring - I think there's a few novellists currently quietly (or maybe not so quietly) cursing they hadn't thought of that as a plot line.

What she did was clearly a deception, and as such she should shoulder the full responsibility for her actions.
Having said that, the child that has resulted from her despicable action is not to blame, and there is no reason why it should suffer for the sins of the mother.

Hopefully the (reluctant) parents and courts will find a balanced solution. It being in the USA I doubt it.

How on earth can anyone place a judgement on the head of this woman ? Ok her act may have been terrible and awful for the somewhat bemused father. But there are millions of women desperate for children who use turkey basters and all sorts of other methods to conceive.

I want children. I may not stoop to that level but try being a woman when your clock is ticking fast and see how you cope.

I think he's a bit more than 'bemused'.
And I don't blame desperate women for trying any means at their disposal. Although many of these attempts usually are with the full knowledge and cooperation of the potential father.

In this case, however, the 'desperate' woman did not have the knowledge, cooperation or consent of the 'father'.

Maybe it would have been less of an issue had she not sued him for paternity and a slice of his income.

Her impregnating herself with his sperm is one thing. The father may not be amused, and it would have been nice of her to ask, but personally I don't find it that big a deal. That she can then (after wilfully impregnating herself, when the bloke had no cause to assume he had impregnated her) turn around and sue the father for child support to the tune of $800 a month is beyond belief.

She actively took steps to get pregnant without him knowing, and now she expects him to pay for it. I sincerely hope he wins the case for psychological damage, and wins a great deal more than he has to pay in child support.

I'll re-iterate that despite the bad wording of that article, the method of fertilisation is under debate. If she did do what the article said, then:

She could have gone to a sperm bank. She was doctor so she should have known about them, and her considerable wage should be able to cover the charge. She could have adopted. There are so many kids given a near-life sentence in homes because there aren't enough suitable parents to adopt them. She could have gone into fostering, too. She could have joined the Big Brothers/Big Sisters Of America. She could have brought some real happiness to deserving kids, had she have been a reasonable person.

There was no excuse for her to ruin someone elses life because she wanted a baby. God knows what the kid is going to be like with her for a mother.

While I agree he will have been considerably upset by the whole matter, people seem to find it only to easy to suffer irreparable psychological damage when there is someone to sue.

I think that irreparable (or at the very least, long lasting) psychological damage is likely. If what is said that happened to him, happened to me, it would scar me for life against other relationships with women.

Even just reading it scares the hell out of me. When I was a lot younger, my own mother impressed on me, never under any circumstances trust a woman with a contraceptive issue. If I didn't want to kid, they I would have to take my own precautions, regardless of hers.

And this is coming from another woman!

If I was offered that kind of service like Phillips recieved, I would have felt secure she wouldn't have got pregnant, but now it seems, providing what is said is true, then you can't even have that service without worrying. Trouble is, not a lot you can do about it... :disturbd:

At your age I guess that's understandable - been there, done that. (T-shirt shrunk in the wash, so I used it to wipe oil off my hands fixing cars.)

I think the doctor in this case had the advantage of many more years life experience to offset against the distress.

All that said, I think your mother was a cool lady with sterling advice.

Lastly, if ever offered that 'service' ensure to enquire about spit vs. swallow ;)

But she sued him first :confused: . After she went through considerable effort getting pregnant without him knowing. (Keep the semen in your mouth, stick it in the freezer, and then get pregnant through artificial insemination) Don't you think she should take responsibility for her actions, rather than sue the father, and expect him to pay for her willful actions?

I think the whole psychological damage thing is a load of bull, but I wish the guy luck in winning it...

Indeed I do. And I think her taking FULL (financial) responsibility for the child she bore would be taking full responsibility.

The 'father' did not have to sue her in return, but it's legally a manoeuvre to ensure that if she were to win the paternity suit the he'd have something to fight back with.
And the only ones who are really getting richer are the lawyers.

I am suprised the little guys lasted that long. Some have enough trouble travelling 1' down the sperm duct and up into the fallopian tube. In perfect temperatures, pH, etc.

Have you read the original post? She won the paternity suit, and the father was ordered to pay $800 a month. He's trying to get his money back...

Only in America? - not quite!

I remember a case in the news maybe a year ago when the Child Support Agency successfully won a case for maintenance against an unwitting father. I can't remember the details - I think he claimed that she had told him that she was on the pill.

It does rather amaze me, considering the 99% annual effectiveness of the pill, how so many more than 1% of women on the pill seem to have these "surprise" babies (based on a lot of couples that I know of). Someone must be lying and it's not the pharmacutical companies.

Thats another scary thought. If a pill has a 99% effective rate, then considering there is probably 100 couples using it right now, one of them is likely to fail. If you have sex twice a week, then within a year you might get pregnant.. :erm:

With the pill conditions like tummy upsets can affect it and also certain antibiotics so thats why it's recommended to use other methods of contraception at the same time

I guess it's easy done though - you're half-asleep and instead of the pill you take one of the dog's worming tablets without knowing :shrug: Or you just "forget" and the next thing you know, triplets - are you likely to mention to your partner/husband that it's all your fault? :no:

As for the original subject of the thread - the woman needs help, really does. Of all the ways to conceive :spin:

AFAIK from what my ex told me, If you miss one day, you can take it as soon as you remember, continute with your dose and and you should be OK.

Only just read this... poor guy, must have left a bad taste...

OK, I could have used loads of lines like "brings a lump to the throat", "bet he gave her a right mouthful" etc, but all the best ones have been done...
