In a rare display of common sense the PF has decided not to proceed with charges against the 'big man' who removed a foul mouthed, drunken fare dodger from a train. :tu:

Mr Main, from Falkirk, was not charged but was reported to the procurator fiscal for allegedly breaking the Criminal Justice and Licensing Scotland Act (2010), which relates to threatening or abusive behaviour.

However, the Crown Office now has no plans to proceed in either case.

A woman has admitted racially harassing a fellow Tube passenger after a video of her appeared on the internet.

Jacqueline Woodhouse, 42, was filmed delivering an expletive-ridden rant on a Central Line train travelling between St Paul's and Mile End on 23 January.

A seven-minute long video of the incident was uploaded to YouTube.

Woodhouse, of Romford, Essex, admitted racially aggravated intentional harassment, at Westminster Magistrates' Court.

The prosecution offered no evidence on a separate charge of racially aggravated common assault.

She will be sentenced at the same court on 29 May.

"the 42 year old had drunk so much champagne at a leaving do she couldn't remember any part of the journey"

And a previous for a similar offence. Nice woman...

Well, they say that Alcohol doesn't actually make you do things that are against your character but it will bring out aspects of your character that are normally suppressed.

For instance, if you aren't naturally violent, Alcohol won't make you violent. But, if you have any violence in your character, it will bring it out.

Re: rail racism...

In her defence (and she has displayed indefensible behaviour) if alcohol has brought out her true nature, remember that it is not illegal to be racist, only to display behaviour which causes harm or harassment to others.

In which case her having drunk alcohol should play a part in either side's argument.

Wonder if she will be dealt with as leniently as those Somali women that racially beat a woman whilst drunk last year, doubt it somehow.

Just because the crims in one case got let off lightly doesn't mean other crims should too. Treat this case on its own merits.

So, racism should be tolerated?

But a lot of people who rob, steal, mug and beat people up do see the inside of a prison cell whereas a lot of people who utter racist abuse do not and may not even be arrested. As cookie_365 pointed out you need to take each case on it's own merit but it's unfair to compare a scenario where a racist is imprisoned and a hypothetical thug is let off and use that as a representative of the entire system.

Also, although I can't find it in the story now, there was a reference to a previous conviction for a similar offence.

In an ideal world I would but the world and our justice system are far, far from ideal, the number of violent crooks walking the streets instead of being in jail shows this imo

Tell that to the hypothetical victims out there, I'm sure they'd agree it's unfair to compare the two as well.
