Yes it does count,and then that evidence has to be checked and verified, simply saying jimmy savile abused me is not enough no matter how fine and upstanding that citizen is .He may well have abused all these people but unfortunately unless someone has been writing stuff down or has a list of times and dates then i fear it will never go any further than a "she said" accusation

Of course it is .for example one of the alleged victims may still have a ticket stub that proves she was at TOTP and records would show that JS was there or not ,that would add credence to her claim ,even a diary entry saying what had happened would be accepted,certainly a lot better than the 'evidence'we have at the moment

Says who ? presumably if such an event took place it would be in the ships log ,but Hitchen would sooner rely on a story told to him by someone who was not the ships captain

That evidence has to be verified by what? The Jury decides if it's reliable or not. They will check if the accuser was in the place they said and such but they don't need CCTV footage or DNA evidence. Think about the times when people are convicted of historical abuse, they pretty much only had accusers' testimony.

So why didn't he answer the question he asked then ? blaming libel laws is easy or maybe he forgets that libel laws are there to protect people from hacks like him

He may write for a living, but I think there's a reason he writes for The Express. Rhetorically, the piece is utter crap. There is nothing in the article to back up the claim. There's is just the claim. The article then meanders forth with some totally unrelated musings and factoids (or not), before another claim that doesn't bear any relation to the surroundding narrative is inserted. Then you come to the end of the article and you ask yourself 'what have I learned from this article', and the answer is 'not much more than the fact the Jimmy Savile was not a nice man'. Well wow! Well done Brain Hitchen!

Ok no problem. I defend your right to be wrong. I have been aware Savile was not to be left alone with children from the early 80s and was amazed to see him on television with children :mad:

I just think it's an extremely poorly written article,and I'm dubious as to some claims it makes as a result. That doesn't mean I don't think Jimmy Savile was a serial rapist and paedophile.

I know all that and have not said any different but even a jury will not convict soley on person A saying person B did something it would need to corroborated .In this case the only corroboration is the claims of other women saying he abused them also whether or not a jury would accept that or even if the cps would allow a trial to go ahead on such flimsy evidence we will never know .We can all have our own personal 'verdict' if you like ,but that is all it will remain .

My own personal view is that a lot of the accusations are simply people applying standards from 30-40yrs ago to modern standards .He may have had under age sex or he may not but i will not accept the word of people who had ample opportunity to out him without some proof or strong corroboration of their accusations.

Yes they could convict on the basis of evidence from the accusers. If all the women were believable, i.e no reason to think they are lying, then that isn't flimsy evidence at all.

Yes that's true ,and the decision for a jury not the press or people taking advantage of a dead man who cannot be libeled or refute them .This must be a red tops dream knowing they can print practically anything and not have any recourse

How? Such a claim could only succeed if it could be proved that the stories being written about Saville were intended to harm the ongoing business interests of his estate, and had actually done so. "Malicious falsehood" isn't simply an interchangeable complaint that remains available in circumstances where a claim of libel is not. It is quite different.

I agree, it's hearsay and rumour but when placed with the things that Esther Rantzen & Paul Gambachini (?sp) have also said about him it's looking pretty damning.

And if you combine that with the things that Savile himself has said and written it becomes very hard to dismiss the allegations as just hearsay and rumour. There comes a point where it's actually far more likely that the allegations are true.

Agreed ,what we need is for drivel like that to be totally separated from other articles that contain some facts and reasoned comment .Personally i am going to wait for the dust to settle and the real facts to come out before forming a judgement .Eventually the band wagon jumpers will quietly disappear leaving those with genuine complaints to be heard

Yes, that's fair enough. I've made up my mind after doing some research earlier in the week. Like you, I was highly skeptical, but I soon found I couldn't maintain the skepticism. When you couple that with 40 allegations of abuse, and reports from people saying it was an open secret, reports from people that claim they've seen him abuse children, or saw him in bed with a 12 year old, it becomes very hard to escape the conclusion that Savile's image was carefully crafted to deflect allegations of abuse, and that he has managed to pull it off.

I just wish he was alive to be able to answer the allegations. and to be able to clear his name or to take the punishment he deserves (if it is proved to be true)

these stories if false are harming his estate, so much so his charitable trust are dropping his name perhaps and speaking of libelling the dead how did the Watson case turn out in your neck of the woods.

He may have had access to a lot of power behind the scenes. He doesn't necessarily need to have that power himself, but if he had access to those who did, he could have ended careers.

I am actually beginning to wonder if Jimmy Savile has playing a massive joke on everyone! An attempted rehabilitation of Peter Sutcliffe? Not for the first time on here I point you towards Brass Eye.

Another thing to consider is the stuff people are now looking back on in this new context of Jimmy Savile being an alleged child abuser and finding something sinister in his previous, hitherto viewed as 'eccentric', actions. What I find funny is that these statements and actions are hardly subtle: defending Gary Glitter, making jokes about girls being under 16, chaperoning dances for at risk children 'as long as some of them stay with me, as a bodyguard haha' and denying that he ever went to that Jersey care home until a picture of him emerged as being there. It's amusing that people are now looking back at all of that and deciding that actually it's quite a bit dodgy. Reminds me of a joke The Simpsons would make, if it wasn't so serious.

I was thinking that it was an attempt to deflect attention. Like, "He wouldn't be stupid enough to make jokes about this if he was up to something. He is making jokes about it, so he's probably not up to something".

But, as you say, he may just have been playing a massive joke on everyone. Whatever it is, he seems to have gotten away with it.

As previously explained, the first underage girl that he now lives with is now over the age of consent. The police have spoken to him about this, but no action was taken due to lack of evidence.

The current underage girl is merely a rumour. The police would not be interested and, as I said earlier, there is no legal requirement for one to report a crime, be it real or perceived.

I think if the family have asked for the gravestones to be removed then it must be conceded that the evidence against him is overwhelming especially when coupled with the statement from the police .It certainly does shake my belief that people do good because they want to and not for what they get out of it :(

I do think that the people who suspected this might be going on, and by that I mean the people who had a position of responsibility - for example the nurses at Stoke Mandeville, should also be investigated. I find it disturbing that there are people coming out now saying that they encouraged kids to pretend they were asleep when Saville came to visit, yet did not hilight this when it happened. If it was as common knowledge as it is supposed to be, then they should be punished appropriately.

Even in cases where it was reported, little if anything was done with it. And this doesn't seem restricted to the BBC or Stoke Mandeville or Jimmy Savile. Just look at the scale of the abuse in the Catholic Church. How could that go on for so long without people speaking out.

I think that is true ,but isn't that what charities like Childline and the NSPCC are for ,more specifically childline where children where encouraged to phone anonymously

True, but you still have to see it in the context of the time. Browsing some forums when reading up on this, there was someone saying that she used to work in a shop on Saturdays in the 70s. The shop owner decided to grope her one day, and she told him not to touch her. She was fired the next week, and didn't dare tell her parents the reason, because she felt they wouldn't believe her. Now, obviously, this is purely anecdotal, but it does indicate that the mood over sexual abuse at the time simply wasn't comparable to what it is these days.

I daresay that there 1,000's of claims like that and most true but attitudes changed in the 80's 90's and 00's progressively getting more favourable towards the complainant so no body can tell me that none of these allegations would not have been investigated or believed ,this has been evidenced by the number of people that have come foward about catholic priest abuses in recent years

Yes, they came forward in recent years. This too took decades before people started to realise what was going on. It's likely to be similar in Savile's case.

I don't remember who it was, but I saw some woman interviewed saying that within the Beeb, there were vile rumours about everyone who was someone. At first she paid attention, but when she became better known and became aware of unsubstantiated rumours about herself, she realised that that simply was the environment she was in, and stopped paying attention to the rumours about others.

but that is what this whole thing is about ,loads of claims and rumors with little evidence and all of a sudden we believe it without question .The whole point of, for example , childline was to provide a medium where children would be believed where parents and other influential people have turned their backs and have denied the abuse because they assume they will be believed over a child .
Don't you think that if Rantzen knew of these rumors(as she admits) then didn't she have a duty to force an investigation or at least ask questions openly ,maybe not about one particular person but the culture as a whole which would ultimately have exposed people like Saville a lot sooner

No one has provided any proof at all ,my argument is that if these rumors where investigated to just to prove his innocence and put the "unfounded rumors"to bed even 5 years ago then it would have possibly come out that he wasn't innocent

One would imagine that the number of victims of abuse in the Catholic Church is considerably larger than the number of victims of Savile, thus making it more likely that some will come forward.

I think with the Church it has to have something to do with the scale of the organisation, and also the fact that you are going to be accusing a body of moral, spiritual ethics as such. Jimmy Saville was one person. WOuld he heve yielded so much power to stop people speaking out about him.

Jimmy Savile was also a national treasure. He also used his work for charity to stop newspapers printing allegations, and we can only guess as to what injunctions may have been out there.

I think that this shocking case, will bring some daunting and sick information about offenders revolving round Saville.

If Gary Glitter was involved - like it looks and some paper have stated that it involves a famous soap star and a DJ, it just makes you wonder how big this story will be.

But, the victims which have been in the media, just proves how sacred they have been by waiting this long and heads should role.

If his activities were so prevalent I am wondering how this all didn't come to the ears of the press any time in the past 30+ years..seeing as they seem to have managed to nose out so many other private secrets across the years.Also with the methods employed by some in the industry how is it that no one hacked or investigated him if they thought he was so odd? Very easy to point the finger at those who now are questioning what they did know of the man because if it was such a well known secret how come the press never got any idea of what was happening.

Could it just be there was just a different attitude then.After all when I consider what Bill Wyman got up to with equally young girls and was barely mentioned by the press I can only wonder why there wasn't a bigger outcry.:erm:

Very easy to point the finger at those who now are questioning what they did know of the man because if it was such a well known secret how come the press never got any idea of what was happening.

Because Jimmy Savile was a good litigator, he had good knowledge of the law and he used it for his own ends. Bill Wyman to name just one had young girls throwing themselves at him, in 2010 his old girlfriend admitted they had sex when she was just 14 LINK :shocked:

And you know this for a fact! HIGNFY S17 e7 It's the kind of thing you witness and never ever forget. Why both Ian Hislop and Paul Merton have said it's a hoax is beyond me but that part transcript I posted IS verbatim. Time will tell as I can't be the only person to view the show. The other nagging fact is Savile was on Mertons team not Hislops and I thought at the time it was a bit OTT

All other solutions require a convoluted explanation as to why they would expect to get away with lying about something that would have occurred before a live audience and would still exist on tape in the BBC archive.

However, the "transcript" is 100% fiction. It's not helpful to the discussion to use a work of fiction to explain your memories of a factual event, especially when so many idiots have been on Twitter this week, circulating the "transcript" as if it is a record of a factual event.

In fact, it is not even a transcript; for it to be a transcript, it would have to be a written record of an actual spoken conversation, and it isn't.

When you say, "let's keep it open and see what pans out," it sounds as if you still want to believe that the "transcript" is true, or at least that it is representative of some hidden truth. It is not. It is an artwork. The reason it works so well, and has taken in so many people this week (and did so in late 1999 when it was first "discovered" where it had been "hidden" on the SOCAA website), is that played on an unspoken unease a lot of people felt about Savile even back then, and of course what a lot of people in his orbit had good reason to believe was true.

The best lies (and the best hoaxes) always contain sufficient truth to make them believable. The "transcript" is an extremely good hoax because while the conversation it relates did not occur, what it insinuates about Savile, it now appears, most certainly did.

YouTube is getting hotter on removing breaches of copyright. I suspect the bots act on newly-uploaded material whilst leaving historic content alone, unless they get a specific complaint. If the HIGNFY clip has recently been uploaded by someone trying to inform the current discussion, then I would expect to see it spotted and removed by the copyright bots within a short time. I've had a video from a school halloween party taken down before, because YouTube identified the soundtrack and determined that it does not have a deal with the record label that would allow the video to be played in the UK.

I found the clip on Youtube and gave it a mark. The only bit that was missing was the scaithing remarks.... As I have said a few times I am not claiming the script is one 100% true only the part I quoted. I 100% remember it being shown.

They have now in their wisdom removed the copy from YouTube due to copyright or they don't want people to see the truth. :shocked:

Well still think it is down to different attitudes back then because if any of those cases had happened in the last decade there would have been furore throughout the press about it especially with certain newspaper's proven predilection for phone hacking and other misbehaviour.

Otherwise I think we would have read more about it at the time.
