So here we are long after the witching hour and thus judgement day has now arrived and we have lost 4 channels thus from last night and what have Virgin replaced them with and the answer to that is sweet nothing and again it seems the case of Virgin taking their customer's for mugs whilst raising their prices again and again for the same or even less content whilst SKY and BT roar on with their gleaming new battleships at their disposal it seems Virgin have only one weapon at their disposal and that is the trusty old water pistol.:sniper::sniper:

The reason I have it is because of the BB nobody can get close to even the slowest of virgins speeds in my area, but the loss of ESPN's 4 channels is I believe a serious break of contract on Virgins part, I will be getting my business partner to look into this today as he deals with company law.

If you aint a Sports fan it means nothing, but like yourself decidedly unhappy about losing, what, a third of our normal weekly football, with nothing as ever coming out of Virgin HQ :mad:

I'm not bothered about sport, but after 13 years of glorious cable TV I have decided to give sky a go for a year. Going to keep the BB. Just want to see how the other half live, then in 12 months time they might have got their **** together and welcome me back with open arms.

Unless something happens before 6pm (or new channels are anounced later today) this is a MAJOR failing by VirginMedia! The lack of information from VM does not help either :(

I am honestly surprised that a company aspiring to be the best in the market has told customers NOTHING... I'm off work today so will be on the telephone trying to find out what the competitors can do.... Not happy at the loss of espn, I don't want to pay any extra so having at least some sport included was ok (ish) for me...

And he will just tell you it was beyond Virgins reasonable control, it's not as if they have had the choice that the channels left the service and that BT wont give them new ones. So good luck trying to take them on!

Virgin don't own any channels so any of them closing are beyond its control. It's not about that though. It's about whether any changes VM makes are 'significant changes' and paragraph J3 applies. To lose a set of channels which VM sold separately for £8 a month would probably count, in my view.

I think my 17 year relationship with Blueyonder/virgin could soon be coming to an end. As I write my broadband is down again, Im a sports addict, especially the womens game, and it sadly looks like that will be gone off my TV screens. BTs first womens game is on saturday, should Virgin not have coverage by then I`ll be off. It seems like this happens every time there is a new provider.

Well folks hate to say I told you so,new channels were never on the cards,was always losing espn and after me brew and toast it's a call to vm to downgrade this poor excuse of a TV provider and believe in better .
The yanks are ruining are football clubs now there ruining our chance to watch premiership live footy and to make it worse charging the same.

J3 says "any changes Virgin Media makes". Again, they have not made that decision. As as been said here multiple times and by Virgin Media themselves, you will not be able to leave your contract over the loss of ESPN

Could do with an update from RichardCoulter, he should check why there appears to be a confidentiality agreement on a contract that has never existed.

I think you could as Virgin Media have had many opportunities to keep ESPN but have failed with poor negotiation with BT - therefore it is completely there fault in making these changes as they could have kept ESPN if agreed to BTs offer.

Or as someone said last night a schoolkid who spent the last 12 hours laughing at everyone. Saying he/she is dead to you is a bit harsh though. If it was me saying that I'd be slaughtered for saying it. Best thing to do now is put him on ignore list, he/she will soon get bored if no-one bites.

That's not true. As channels are wholesale contract is with virgin therefore can cancel. But what date were you informed by virgin espn would be leaving is the key question

It is normal that all parties sign a confidentiality agreement prior to any discussions/negotiations on a major contract. I work under these type of agreements every day.

Yes but the channel closed at the same time said wholesale agreement was up, all of this is of no choice to virgin. ESPN shut down and was transferred to a new broadcaster, the existing ESPN contract would be worth diddly-squit.

No they haven't. ESPN have shut down. How is that Virgins decision?

The name ESPN has transferred to BT, therefore any existing contract for ESPN doesn't exist. Again it is not in Virgin Medias control as to whether the channel shut down.

I hate to say told you so but this is defiantly the reason VM have phoned, mail shotted and emailed me constantly over the last 3 months so they can tie me into a new deal so I can't bugger off the day they became 3rd rate (today).

Well you can't really have negotiations without an offer! Or have Virgin and BT just been sitting in room saying nothing to each other for last x months? BT would have to at least put their starting offer on the table £12 for SD and £15 for HD and discussions would have gone from there?

BT bought the rights to ESPN therefore VM lost them. All VM would have to show is that the cost of retaining those rights or getting the channels through BT was not in their shareholders interest (a legal requirement) and they could justifiably claim the loss of the rights was outside of their reasonable control.

I'm more angry with BT than Virgin over this. IMO we would have had a deal long ago if VM had just done what Sky did & added it as an extra sub for £15 a month like Boxnation. How many people would have subscribed to it though? I'd fall into the category of a mad sports fan but I wouldn't pay it. What VM are trying to do, is engineer a move whereby Virgins product (VIP/XL) offers the best deal possible to customers (better than Sky). This would also boost viewership for BT, problem is, unlike most TV operators they don't seem that worried (right now) about the lack of people watching the channel. They're more concerned with selling broadband & BT vision or whatever it's called. BT's numbers will significantly drop off next year once the people with broadband stop getting it for free. Sooner or later I think BT will come round, how long that will take is anyone's guess though, could be 2 weeks or maybe a year, possibly even longer than that!

This is the latest from someone who has close knowledge on the in's and out's of what is happening at this present moment.

We're still negotiating with BT so until an agreement has been reached these channels will not be distributed on Virgin TV. We’re open to do a deal before or after the start of the Premier League season on 17 August.

We’ll keep you up to date with any developments right here on Home as soon as we can.

Disseminate the above and it states "If we virgin make significant changes". They are not legally making the changes and if you note they put the term "Services" in bold - nowhere in these terms to they quote content.

As I said a few days ago, I am sure VM view August the 17th as the key date rather than today. They'll leave striking a deal until as late as possible to get the best deal they can, it's what they've always done.

Are the 4 channels still testing? If so does that suggest that something is going to be launched soon or were they testing BT Sports on the assumption of a deal being done?

Personally I don't think 1 August was the absolute deadline for a deal, more like the first EPL match on 7 August(?). I'm not giving up hope just yet.

If it doesn't arrive then BT won't get any money from me and I'll use my VM broadband to stream one of those dodgy footy sites ;-)

What a bad day for VM and it's customers, just proves false rumours happen!. SA, anyone, wasn't that supposed to be happening from today!.

Never thought I'd say it, but I am losing faith in VM's ability to negotiate anything. Very poor from a so called Market Leader.

Not a big sport fan myself but do appreciate this must be really frustrating for many.

The only way I can see BT Sport coming to virgin media is for everyone to pay for it like you do on Sky. I know VM are probably trying to get it free for the top pack / s but if BT play hard ball and refuse to let them do it thats there only other option

Here is a great example of how we are all different and have different demands. VM have launched Sesame Street into the on demand channels. On DS there are comments such as

VM are really missing a trick, appreciate them holding out for a better price but at the end of the day they should let the customer decide.

According to reports, Premier Sports, BT Sports and Sky Atlantic* were not taken up because VMs stance on price. I would have thought that quite a few customers would have been prepared to pay extra as stand alone or even an XXL TV pack.

I think I've got to the point with VM that I feel they are always going to be handed the scraps and last in the queue for content. As much as I love Tivo and their broadband service I have to say content (in particular HD) is king. So having suffered no Sky Atlantic, over a year without ITV HD, other HD channels missing I find that losing ESPN and not getting BT Sports is the last straw for me.

But you know what really f***s me off, no statement or update from VM!!!!

If you really don't believe that the content VM provides comes under the provision 'Services' in the terms, then I don't believe you're up to much on the contract front.

I called up to cancel yesterday (although I had no intention of doing so as I had 6 months left on my current contract and can't get Sky in my flat).

I got a £15 p/m discount, reducing my TV XL, 60MB BB & weekend phone package from £63 to £48.

Personally I think people are being a bit quick to jump down Virgin's throat on this one. BT want to get as good a wholesale price as possible from Virgin. Virgin want to keep it low to hopefully include it free on XL. By not doing a deal early Virgin will have lost quite a few customers. However this puts them in a very good bargaining position with BT in the coming weeks.

BT need the extra money that Virgin will bring in, both via wholesale subscription and additional advertising revenue from the extra viewers they will get. I would be very surprised if a deal is not done within the next few weeks.

Disseminate the above and it states "If we virgin make significant changes". They are not legally making the changes and if you note they put the term "Services" in bold - nowhere in these terms to they quote content.

May or may not be fair but legally they cannot be challenged under these conditions.

It appears the main problem is BT don't want wholesale they want to control the sign up's them selves like there doing on Sky. If VM could get that system on cable like Sky have BT Sport would have been announced ages ago

If you are that sure you are right and I am wrong then there is nothing more I can say or is worth saying. Even if the subject and my knowledge of it has kept me employed for the last 35 years.

Never know maybe VM will take the moral ground rather than the legal one.

Personally I think BT would not get as much money through individual sales than they would through a package deal. They would certainly get less viewers, which means less ad revenue. I doubt there's many who'd sign up for 12 months at £12p/m and if people could sign on a monthly basis they'd probably only do it for the games they wanted to watch then cancel.

This is where i get frustrated!

I still believe we will get BT Sport before the PL starts but a very important date has passed and there is silence from VM about the issue.

99% of the time they are a pretty good all round company as far as customer service is concerned but this lets them down massively!

Well, it turns out that I can't get BT where I live.... No fibre optic cable!!!! So, I have to go VM or Sky, and the best BB speed Sky can offer is an estimated 2.5-4.9..... Might as well go back to dial up!!! Looks like I'm stuck on VM then..... Gutted

Looking at Virgin's Facebook page this morning, almost every post is customers complaining about BT Sport/ESPN, and the same copy and paste message in response. Working on that today must be hell :D

You'd have thought VM would have had a backup plan if they didn't get BT Sport, but since nothing new has launched they obviously didn't.

No news on UPC adding BT Sport, although on their website under premium channels the Setanta pack has disappeared since yesterday.

Well Im stuck in contract if I downgrade cheapest I can get it to is £50,and anyone hoping for any developments today regarding bt can forget it.i have been told by retentions they are not expecting any change of stance with bt today and when I asked about sky Atlantic he confirmed still in talks but like I was told over several weeks ago possibilty of autumn if in fact we do see it

This thread has gone beyond ridiculous. Only yesterday and after 11 hours today there have been over 50 pages of nothing besides what's NOT coming soon. God knows how many there will be at the end of the day.

Am i ****ed off with virgin not getting bt sport..not really,,as looking at the football that they have on in the coming months they are covering the 12,45pm slot on a Saturday dinner time i will be out then on my way to watch the team i support...there is always match of the day to catch up on the goals

BT have top picks in 18 of the 38 rounds in the season. So far they have only had 5 of them. I would imagine that they'll have more appealing games in the 2nd half of the season. Sky did a good job of choosing theirs in the early games to make the BT offering look poor.
