But the law has been enforced, as far as I can tell. There are presumably provisions in this particular law that allows a variation, but only if ordered so by a judge. The law would have been broken if he simply went on holiday and did not ask for permission.

Either that or his lawyer requesting the variation in the conditions gets another legal aid payout. I know which one my money is on. Besides the going rate for a breach of bail conviction in Scotland right now is 1 month in the pokey. This is cut in half automatically plus extra early release drops that down to a couple of days at most and means pretty much any bog standard bail breach doesn't actually incur any punishment. |

I would have thought that the criteria would be more based on whether the criminal was flight risk, rather than what they were convicted of.

I have no idea, I am sure the judge would have taken that into consideration. Perhaps his mother put up a good case to serve as his "minder" to ensure that he returns. I didn't see anything about his bail being increased or not. Maybe they put the bond up?

All that should have happened is that he should have been made to surrender his passport regardless of the holiday being pre booked.
I wonder if the same judge would have let a juror go on holiday even if their holiday was pre booked. |

I'm not sure if having to go to see Lady Gaga is more punishment than being on a curfew.
