AUP Warning Letter - how much is too much?

I have received my final warning from VM that I have been using my 50Mbit internet too much. I admitidly have been using it a lot and I'm quite happy to change my ways, but does anyway know how much is a daily ammount?

I never recieved my first warning in the post. The second one I replied with a complaint letter to VirginMedia asking them how much I need to reduce my traffic by with no response. Not I have a third letter and still am none the wise on how much I need to reduce my internet usage by.

I really don't want to get removed and I'll make sure I reduce my traffic, but I haven't got a clue how much I need to reduce this by.

I've change my traffic so that I only use 1Mbit uload during peak hours and 5Mbit down for P2P and torrents. (the maximum isn't in use all the time).

They've said that ~350GB/month between 9am and 9pm has been the threshold but this is subject to change as they don't have a set limit, they target the top 0.1% within a congested area.

That 350GB/month is approximately equivalent to a sustained 2.7Mbit/s between 9am and 9pm.

Weird, we usually download a few hundred gig a month, most of that is in evenings during peak time and we havent had a letter, one month we did about 700GB too, maybe it depends on the status of the network in the area you're in?

9pm is a very early cutoff point, which you also discovered on your connection when you still had peak affects close to midnight. No wonder I regurly see spikes between 10pm and 1am now as that period is often more busier than 6pm to 9pm. You sure its 0.1%? lets say there is 40 users on a port, that 0.1% is just 1 user.

I would say sustained 1mbit upload will still get you in the net. Their capacity didnt go up by that much during the uplifts and they wont be able to support many using sustained 1mbit upload. Is it not possible to simply turn off p2p during peak? It sounds like you running it 24/7 from your description. You had 2 letters so I would either disable p2p during peak or set the upload to something very low like 256kbit. Sustained 5mbit download they should handle a bit easier but I would also consider lowering that as well.

i had a long chat after my letter.
they said they couldnt give me any guidelines at all as it depends on what everyone else on my part of the network is up to at any given time.
i said thats a bit silly and have since been worried when i use it to download even a few hundred meg at peak times.

I asked if downloading 1GB at peak time would get me another letter - the guy stressed again that he couldn say one way or another as it all depends on how busy the network is. I then asked would HE download 1GB at peak time and he replied he wouldnt as it would be risky..
since then i have waited until 9pm to download anything (which is a pain when i want little things)
