My Czech neighbours, working here on Work Permits (as members of an Accession 8 EU country), are about to have a child born here.

They are as confused as I am on the child's nationality.

Will be the child be British, Czech, both, or Stateless?

Do they have to register the birth in the UK or Czech Republic?

I've been digging on the internet, but old rules appear, that have been superceded without reference to the new rules.

Anyone got any accurate help? :dunce:

I'd ask the council. They should know.

If the child is born in the UK their birth will need to be registered with the local council within 42 days.

The council will probably be able to advise whether the child then needs a visa to remain in the country.

Being born in the UK does not automatically grant citizenship, however if the child resides here for a further 6 years can claim citizenship (though how they do the exam and pledge alligence I do not know), maybe the parents claim citizenship and the child tags along by default, else at 18 can apply if they still live here.

The birth of a child to a Czech citizen in the U.K.
If your child was born in the U.K. and you were a Czech citizen at the time of his/her birth, send us a self-addressed and prepaid envelope (format A4) together with a letter stating that you would like us to send you the application forms needed for registration of the birth and an application for the Certificate of Czech citizenship for your child. Please send the envelope with the letter to this address: Czech Embassy, Consular Department, 26-30 Kensington Palace Gardens, LONDON, W8 4QY.

In the letter:
write that you would like us to send you the application forms regarding the registration of birth and an application for a Certificate of Czech citizenship for your child
inform us whether the child was born in or outside marriage
inform us whether you would like to lodge an application for the child's Czech Republic passport. Being as the child is not likely to be entitled to a UK passport it would look like they would need to apply for the Czech passport if they plan to take her home to visit relatives etc.
