Because, AIUI, what he is doing, whilst unethical, is not illegal.
If he took the photos he holds the copyright and is legally allowed to do anything he likes with them provided he doesn't defame the subject.
It might not be illegal but surely ebay has rules which prevent this sort of behaviour.
