hi i got my bill today which has been £24.99 a month for the 600 so i was a little shocked to see a bill for £45.12 :Yikes: so i rang as you do and the ntl chap told me i had rang up on the 15th and upgraded to the 1mb.which i didnt and only i know the password .i all so said why would i upgrade when the speeds go up next week anyway . ok rant over but does any body no if i will have to pay the extra or should i

There's your ammo then - speak to them again saying you havn't ordered this, and aren't actually subscribed to the speed, so could you be refunded for the service you're not getting - sounds fair enough to me :)

I would change the password while you're at it though, just in case.

Technically, if you never ordered it you are not responsible, however proving this can be tricky.

In 2001 someone added porn channels onto my (then analogue) service. I didn't notice til I got the bill. Even though I worked for the company I still couldn't get out of paying for it.

Get it changed back down and get all the passwords changed.

If there IS a password on your account, you could throw that into the ring by insisting nobody else knows it, and that therefore the upgrade must have been processed without the password being checked. In my case, at the time I had no password, so I hadn't got a leg to stand on.

Also surely there is proof by checking the telephone calls made, the CS rep said the customer rang on the 15th - there should be evidence of this logged?

In my case, at the time I had no password, so I hadn't got a leg to stand on.
Presumbaly NTL told you this - you being the named subscriber. The burden of proof would almost certainly have been with NTL to prove that the variation of contract existed, not with you to prove that it didn't.

If the information was on your file, then NTL would have to have proven that:
1) It was positively you that made the variation (without a password, this would be difficult);
2) There was very little possiblity of error on their part, for instance, a mis-interpretation of a call from you, or it should have been put onto someone else's account (with their record ....).
3) There was very little possibility of error on your part, for instance, if you suffer from memory lapses!

My feeling is that, based on the above, you should have stood a good chance of getting your money back.
